769.01 DEFINITIONS.
   (a)    As used in this chapter:
      (1)   “Regulated items” means:
         A.   Monument plaques, statues and sculptures composed of any metal, traffic signs, street signs, and aluminum light poles;
         B.    Brass or bronze bar stock and bar ends, railroad journals, RTA journals, gas meters, water meters, ingots, and #1 copper;
         C.    #2 copper. For purposes of this paragraph, “#1 copper” and “#2 copper” mean #1 copper and #2 copper as specified by the most recent Institute of Scrap Recycling Industries. Inc. Scrap Specifications Circular including residential copper plumbing and electrical wire;
         D.    Aluminum and Vinyl Residential Siding;
         E.    Aluminum gutters and downspouts;
         F.    Stained glass;
         G.    All household fixtures; and
         H.    All fixtures or property found in places of worship; and
         I.    Motorized and non-motorized vehicle parts.
      (2)   “Scrap metal processor” means any person, firm, or corporation who processes iron, steel, or nonferrous scrap, and whose principal product is scrap iron and steel or nonferrous scrap for sale for remelting purposes.
      (3)   “Scrap metal processing facility” means any establishment having facilities for processing iron, steel, or nonferrous scrap, and the principal product of which is scrap iron and steel or nonferrous scrap for sale for remelting purposes.
   (b)   Not later than one (1) year after the effective date of this section and at least annually thereafter the Police Chief shall submit to the Council a report as to whether the definition of “regulated items” contained in division (a) (1) of this section should be revised. If, in the opinion of the Director, said definition is in need of revision, the report shall contain the Director's recommendations therefor. The Chief shall make a good faith effort to notify representatives of affected industries prior to submission of the report to Council.
