(a) Subject to the further requirements for all structures as outlined below, every person owning property within the City shall, within ninety days from the date of issuance of a certificate of occupancy, or one year from the date of the issuance of a building permit, whichever date occurs sooner, seed and maintain a lawn per the approved landscape plan, exclusive of buildings, parking areas, driveways and sidewalks.
(b) Every individual or entity who makes application for the construction of a residential, commercial or industrial structure on any lot located within the City shall include a landscaping deposit, the application for a building permit, plans which specifically include provisions for the final grading and landscaping (in compliance with the “Landscaping Guidelines” of the City of Warrensville Heights, Ohio) for said property, including the installation of seed and/or sod for the lot upon which construction of a structure is proposed. Plans for grading and landscaping shall be subject to the recommendation of the Planning Commission and approval by City Council.
(c) Failure to comply with the requirements herein shall constitute a separate offense for purposes of the penalty provision of Section 1357.99.
