(A) The Town Council has authority and responsibility for the custody, management, maintenance, and control of Tower Park, and sets out the following provisions with regard to aspects of the rules, regulations, management, preservation, ornamentation, improvement, maintenance, and control of that park.
(B) Except as otherwise authorized by duly constituted authority of the town, in which instances such exceptions shall be prominently posted as soon as practicable; and except such conduct violating the provisions of this chapter also violates an existing statute of the state, the following rules and regulations shall govern:
(1) Hours. No person other than a duly constituted law enforcement officer, town employee, or person in the company of such officer or employee, and no vehicle other than one on town business, shall enter or remain in Tower Park between the hours of 11:00 p.m. and 6:00 a.m., excepting only in specific instances of organized activity authorized by prior action of the Town Council.
(2) Nuisances. No person in Tower Park shall at any time engage in any activity which results in noise or other nuisance which interferes with the reasonable enjoyment of the ordinary comforts of human existence by persons who are lawfully in Tower Park or lawfully upon property in the vicinity of Tower Park.
(3) Alcoholic beverages. No person shall use or possess alcoholic beverages at any time in Tower Park.
(4) Speed limit. Except as otherwise posted as authorized by the Town Council, the speed limit in Tower Park for all vehicles and modes of transportation is 15 miles per hour.
(5) Unsupervised children. Children under the age of six years shall not be in Tower Park, excepting only under the supervision of a competent adult.
(6) Littering. No person shall throw, discard, or otherwise dispose of refuse in Tower Park, other than in containers appropriately designated for the deposit of such refuse.
(7) Posting bills. No person shall paint, print, post, or in any way affix any poster, bill, or advertising matter of any kind within Tower Park unless the consent of the Town Council is first obtained.
(8) Damaging town property. No person shall willfully mark, disfigure, injure, tamper with, displace, or remove any improvement or any part or appurtenance thereof, or any signs, notices, or placards, whether temporary or permanent, monuments, or other structures or equipment, facilities, or park property without the prior consent of the Town Council.
(9) Damaging plants. No person shall willfully cut, pluck, injure, or destroy any plant growing in Tower Park without prior consent from the Town Council.
(10) Discharging fire arms. It shall be unlawful for any person to discharge any firearm in Tower Park; provided that this provision shall not apply to law enforcement officials in the lawful exercise of their duties.
(11) Congregating. No group of persons shall congregate in a crowd of three or more within Tower Park so as to obstruct, hinder, or annoy passersby or occupants of Tower Park or adjacent premises, or as to interfere with the activities normally carried on in Tower Park.
(12) Burning. It shall be unlawful for any person to burn or cause to be burned any substance in Tower Park, excepting only in grates installed by the town in the Park for such purpose, or in other locations clearly posted for burning pursuant to authority of the Town Council.
(13) Placement of tents or any other structures. It shall be unlawful to place any structure, including tents, within the confines of Tower Park without prior consent from the Town Council. Such stipulations as set must be addressed in application to the Council.
(a) All rules and regulations governing the park must be met.
(b) The structure may be erected the day of use and must be removed immediately following. In no event shall the length of time exceed 24 hours without the express permission of the Town Council.
(c) The structure shall be erected in a perimeter area of the park, as any public use of Tower Park shall not be interrupted.
(d) For permission to be granted, application to Council must include exact time of placement, time of removal, and definition of site to be used.
(14) No person shall operate a skateboard, rollerskates, roller blades, bicycle, scooter, or similarly wheeled vehicle, or any vehicle, upon the Tower Park Walkway, that area being defined as a pedestrian area encircling Tower Park but not considered as developed for vehicular traffic.
(15) Smoking.
(a) The entire area of Tower Park shall be nonsmoking, which does include bleachers and stands, play areas, playing fields and dugouts, basketball or tennis courts, structures and any other such area(s), which would also include parking lots, driveways and all general areas of Tower Park.
(b) Exceptions: Warren Conservation Club and any area(s) so designated by authority of Town Council as a smoking area(s) by placement of signage and/or other identifiers.
