1713.01 LICENSE FEES.
   (a)   After December 18, 2000, license fees for food service operations as defined in Ohio R.C. 3732.01 shall be based on risk assessment according to the guidelines set forth by the Ohio Department of Agriculture and fees will be based in a consistent manner. The amount shall be determined by the Public Health Council pursuant to Section 3732.01 plus the following fees:

   (b)   After December 18, 2000, license fees for non-commercial food service operations (government, schools, not for profit youth groups and organizations described in subsection 501c3) and which are tax exempt under subsection 501 (A) of the IRS Code of 1986, 100 Stat. 2085, 26 USCA1, as amended) as defined in Section 3701-21-021(C) of the Ohio Administrative Code shall be established in the following categories and amounts.
 
Non-commercial accounts
50% of above fees in risk level.
   (c)   After December 18, 2000 license fees for mobile food service, vending food service, and temporary food service will be established to the guidelines and current regulations of the Ohio Department of Agriculture and Health and shall be determined by the Public Health Council pursuant to Section 3732.01 as follows:

   (d)   In the event a license is not renewed prior to its expiration date, there shall also be a late fee charge, in the amount of 25% of the license fee described herein.
   (e)   Pursuant to Ohio R.C. 3732.04, a special fund has been established and will be used only for the purpose of administering and enforcing Ohio R.C. 3732.02 through 3732.08.
