749.03 LICENSE REQUIREMENTS.
   Every towing firm or operator applying for a license to provide service when requested by the City under Section 749.02 shall meet the following minimum requirements.
(a)   Premises, including office and storage lot and other facilities shall be located within the corporate limits of the City, with twenty-four hour telephone communication.
(b)   Premises shall be fenced, well lit and shall meet the applicable building and zoning regulations. Outside storage lots shall be sufficient to store not less than fifty vehicles and with hydraulic rack or comparable equipment that would permit thorough undercarriage investigation of a vehicle.
(c)   The towing service shall be available twenty-four hours a day 365 days a year so as to be capable of responding to emergency calls and to permit release of stored vehicles and inspection of vehicles by the City at any time.
(d)   Equipment shall consist of at least:
(1)   Five tow trucks with a manufacturer-rated chassis of one ton or more or equivalent gross vehicle weight, equipped with a winch and boom, manufacturer-rated at four-ton capacity, with cable having a minimum diameter of three-eighths inch.
(2)   Two tow trucks with a manufacturer-rated chassis of three tons or more or equivalent gross vehicle weight, an air compressor, a winch and boom, manufacturer-rated at twenty-five ton capacity, with cable having a minimum diameter of five-eighths inch.
(3)   All vehicles shall be equipped with at least one amber emergency flashing light, at least one work light for winching and boom operations, rear view mirror both sides, one all-purpose operable fire extinguisher and flares as required to mark an accident scene.
(4)   All vehicles shall be equipped with two-way mobile VHF high frequency radios or cellular telephones.
(5)   Such additional equipment as required by rules and regulations of the Director of Public Service and Safety.
(6)   All vehicles shall meet all other requirements of state law or ordinances of the City.
(7)   All required equipment shall be either owned or under a lease agreement to the towing firm. If leased, a copy of the lease agreement shall be attached to the license application. The Director of Public Service and Safety shall be notified within three working days in writing of any change in equipment.
(e)   Every license shall maintain liability insurance with the following minimum limits of coverage:

Bodily injury
$100,000 each person
300,000 each occurrence
(2)
Property damage
50,000 each occurrence
(3)
Cargo coverage
60,000 each occurrence
   A copy of the policy of insurance shall accompany any application for a license and shall show the expiration date and contain a provision that the policy may not be canceled or not renewed without at least a ten-day notice to the City. The policy shall indemnify the City, its officers, agents and employees and any and all third persons from loss or damage by reason of any negligent or unlawful act omitted or performed by the licensee, its agents or employees in conjunction with the towing or storage of any vehicle in response to a City-initiated call. Failure to have proper insurance in effect at any time shall constitute grounds for immediate and nonappealable suspension of a license.
