260.03   GENERAL PROVISIONS.
   (a)   The following provisions shall apply to all Village employees:
      (1)   All positions, whether full time, part time, or seasonal, are “at-will employment” positions, except for the position of Police Chief.
      (2)   All hours worked in excess of 40 per week by hourly employees shall be considered “overtime” and shall be compensated at the rate of one and one-half times the employee’s regular hourly rate. The Village shall follow the Federal Fair Labor Standards Act. The use of sick time, vacation time, employee birthdays and/or personal days to create overtime is strictly prohibited.
      (3)   All employees, except those covered by a collective bargaining agreement, called in due to an emergency situation shall be granted a minimum of three hours pay. An emergency is defined as a condition which necessitates corrective action immediately and which requires that employees be called back to work prior to their regularly scheduled starting time. Employees required to come in early due to another employee being absent, directed to work beyond his or her assigned schedule, or directed during the previous day to report early the following day are not to be construed as emergency situations.
      (4)   The compensation for each class of employee shall be charged to the account for which money therefor has been appropriated by Council and within the limitations thereof.
      (5)   Unless otherwise recommended by the department head and the Mayor, all newly-hired employees shall be hired at the lowest pay rate for their position per Section 260.18. Thereafter, said employee shall advance as recommended by the department head and Mayor.
      (6)   The Village’s Administration reserves the right at any time to implement an unpaid furlough day program recommended by the Mayor and acknowledged by Council resolution and approved by the majority of Council.
   (b)   The following provisions shall apply to all Police Department personnel:
      (1)   The Police Chief and Police Captain shall receive longevity pay in accordance with Section 242.11 of these Codified Ordinances, uniform allowance in accordance with Section 242.14 of the Codified Ordinances, hospitalization insurance in accordance with Section 242.15 of the Codified Ordinances, sick leave benefits in accordance with Section 242.16, life insurance in accordance with Section 242.18 of the Codified Ordinances, weapons recertification bonus in accordance with Section 242.28, and payment during disability period in accordance with Section 242.21.
