(A) Any license issued in accordance with the provisions of this subchapter may be revoked if a dog or cat is found to be dangerous, or if the dog or cat is found to continually make disturbing noises, so as to be a nuisance to citizens of the city. Complaints should be made to the animal control officer or Wake Village Police Department. Determination will be made by the Police Department whether to cite the owner or keeper to Municipal Court, ticket the owner, or issue a warning that will be documented. No animal shall be disposed of if the owner or keeper’s identity is known or reasonably capable of determination, without notice to the owner or keeper. Any dog or cat showing a propensity to bite, scratch or injure human beings or other domestic animals shall be presumed dangerous under this subchapter. If the owner or keeper shall refuse to remove the animal, the animal shall be picked up by the animal control or any other person designated by the Municipal Judge. The Municipal Judge shall have the power to summons witnesses, administer oaths, and take testimony in municipal court cases.
(B) The animal or animals shall be transported to the Texarkana Animal Shelter as they are collected. A five-day hold will be placed on animals, other than those which are obviously unhealthy or dangerous, giving the owner or keeper a five-day timeframe to claim his or her animal. After the five-day holding period, the Texarkana Animal Shelter shall have sole authority of the animals.
(C) All fees due the city for collection and processing must be paid to the city before any claimed animal/animals are released from the Texarkana Animal Shelter to the owner or keeper. In a case where the rabies vaccination cannot be proven, the owner or keeper must contact a licensed veterinarian to administer the vaccine. The city will allow the animal released to the owner or keeper who shall take the animal directly to the veterinarian and then bring the proof of rabies vaccine to Wake Village City Hall the same day, at which time the owner or keeper will purchase a license and pay any fees due the city. Any owner or keeper failing to meet these requirements will be cited to Municipal Court for failure to comply with this section. A remedy for delay of these requirements is a signed and dated statement from a licensed veterinarian with acceptable reasoning, such as age of the animal or a medical condition.
