§ 153.095 FILING FEES.
   (A)   Procedure.
      (1)   In order to cover the costs of examining plans, and other expenses incidental to the approval of a subdivision, the following fee schedule shall apply:
         a.   Minor subdivision or consolidation plat: $50 per plat;
         b.   Major subdivision - preliminary plat: $250 per plat +$10 per lot;
         c.   Major subdivision - final plat: $250 per plat + $10 per lot;
         d.   Subdivision variance: $100 per application;
         e.   Review of special studies: The cost to review any special studies associated with a subdivision plat, such as traffic impacts, wetlands mitigation, flood hazards, coal mines, soil sedimentation and pollution control, etc., shall be borne by the applicant at a cost equal to the current hourly rate charged by the reviewing agency or the city’s consultant.
   If the subdivider fails to begin construction or obtain final plat approval within 12 months after receiving preliminary plat approval, the subdivider shall be required to resubmit for preliminary plat approval and pay the filing fees currently in effect at the time of resubmission.
      (2)   Definitions. The following definitions are hereby adopted for the purpose of applying the above fee schedule:
         MINOR SUBDIVISION. A subdivision that creates less than five building lots and does not require the creation or extension of any public street or public easement of access. A plat that creates less than five building lots but dedicates land to widen an existing public street right-of-way shall be considered a minor plat so long as the street is not extended or lengthened.
         MAJOR SUBDIVISION. A subdivision that creates five or more building lots or creates or extends a public street or public easement of access.
      (3)   All fees established by this chapter are in addition to any sums paid to cover the costs of review of improvement plans and field inspection of construction as required under the provisions of § 153.054.
