The ADA Grievance Committee will be subject to the following duties and conditions:
(A) The ADA Grievance Committee will meet as and when deemed necessary by the ADA Compliance Officer; provided, however, that the ADA Grievance Committee must meet within 15 days after all information necessary to evaluate a notice of claim received as provided in the procedures adopted pursuant to this subchapter and § 38.50. The ADA Compliance Officer will provide at least three days prior written notice to all members of the ADA Grievance Committee of the date, time and place of any meeting of the ADA Grievance Committee.
(B) A quorum of the ADA Grievance Committee shall be three members. All decisions of the ADA Grievance Committee must be by the affirmative vote of a majority of the members. All decisions of the ADA Grievance Committee must be in writing and certified by the ADA Compliance Officer. Minutes of all meetings of the ADA Grievance Committee will be maintained by the ADA Compliance Officer. The ADA Compliance Officer is charged with the safekeeping of all records with respect to the activities of the ADA Grievance Committee.
(C) If any member of the ADA Grievance Committee is disqualified from participating in the review of any claim made under the ADA pursuant to the procedures adopted under this subchapter and § 38.50 because of a conflict of interest or a perceived conflict of interest, such person shall be counted for purposes of determining whether a quorum is present, but such person shall not participate in any discussions or review of any materials and shall not vote on the matter. If for any reason the ADA Grievance Committee shall be unable, because of a conflict, to have at least three members able to participate in any review of a claim made under the ADA pursuant to the approved procedures, temporary representatives to the ADA Grievance Committee shall be appointed by the Township Committee by special resolution at the request of the Township Committee Liaison to the ADA Grievance Committee.
