§ 34.11 DUTIES AND LIMITATIONS.
   The Bi-State Authority shall be subject to the following duties and limitations:
   (A)   The primary purpose of the creation of the Bi-State Authority is hereby declared to be to develop, operate and maintain the facilities of the airport for the aeronautical uses and purposes of the people of the cities and surrounding areas, and to provide on the airport, insofar as not inconsistent with or detrimental to the development, operation and maintenance of the aeronautical use facilities, for the industrial growth of the cities and the surrounding communities and area. No funds of the airport shall be appropriated, used or expended for any purpose inconsistent therewith.
   (B)   Notwithstanding any of the powers granted to the Bi-State Authority herein to the contrary, no action shall be taken nor powers exercised by the Bi-State Authority contrary to or in conflict with the laws of the party states, where applicable, or the regulations and policies of the Federal Aviation Agency or any of the restrictions, reservations or exceptions contained in the aforementioned quitclaim deed, unless the same have been validly released, or any binding contracts of the City of Lawrenceville made in connection with the airport and its use.
   (C)   Each year on or before July 1, the Bi-State Authority shall prepare a budget of its estimated expenditures for the fiscal year beginning on January 1 of the succeeding year and shall on or before July 1 submit a copy of that report to each of the cities.
   (D)   The Bi-State Authority shall have no power to impose taxes upon the citizens of the cities except by and through each of the cities and only upon referendum vote approved by a majority of the persons voting in each of the two cities, and no taxes shall be imposed nor shall the cities be required to furnish funds for the operation or improvement of the airport unless it shall appear that the total income of the airport is insufficient to meet the needs for the operation or improvement. Any such funds appropriated by or furnished by the cities to the Bi-State Authority shall be used exclusively for the development and maintenance of the airport facility.
   (E)   The Bi-State Authority shall keep accurate records of all accounts of receipts and disbursements, which shall be subject to an annual audit and accounting procedures established under its bylaws. All receipts and disbursements of funds handled by the Bi- State Authority shall be audited by a certified public accountant, and the Bi-State Authority shall make an annual report to each of the cities incorporating therein the report of that audit.
   (F)   Any member may be removed from office by the officer appointing him, or the successor to that office, for any willful and substantial violation of any of the provisions of this chapter or the acts creating the Bi-State Authority, for misappropriation of funds of the airport or for conviction of any felony.
