§ 50.21 NOTICE.
   (A)   Notice of voluntary conservation measures shall be by publication in a local newspaper of general circulation or other means as deemed appropriate by the governing body.
   (B)   Said notice shall be effective upon publication.
   (C)   Notice of mandatory conservation or rationing shall be by first class United States Mail or by door to door distribution to each current user, and by electronic and print media.
   (D)   Said notice shall be deemed effective at the conclusion of door to door distribution, or at 12:00 p.m. of the third day after depositing same in the U.S. Mail.

WATERWORKS RATES
§ 50.35 RATES.
   There shall be, and there are hereby established for the use of, and the service rendered by, the waterworks system of the town, the following rates and charges shall be effective July 1, 2022, based on the use of water supplied by said waterworks system:

§ 50.36 MINIMUM CHARGE PER MONTH.
   Each service shall be subject to a minimum charge in accordance with the following applicable size of meter installed, for which the user will be entitled to the quantity of water set out in the following schedule of minimum rates:

§ 50.38 NON-METERED RATES.
   Non-metered and each multiple user served by a single meter shall pay a Phase I flat monthly rate of $37.60 per user and a Phase II flat monthly rate of $44.18.

§ 50.39 METER INSTALLATIONS.
   Each user, at the time he or she is connected with the waterworks system, shall pay a flat charge to cover the costs of: excavating and tapping the main; furnishing and laying service pipe; furnishing and installing corporation and stop cocks; and furnishing and installing yoke, meter, and, if outside, meter crock.

§ 50.40 WATER RATES FOR THE FIRTH ADDITION.
   The owner of each lot, parcel of real estate, or building located in Firth Addition area who will utilize the town’s water utility shall pay, in addition to all other rates or charges, either:
   (A)   A surcharge in the amount of $1,170, which surcharge shall be paid on or before the date which is one month after the town has sent notice to the owners that they may elect to utilize the town’s water utility; provided, however, in the event an owner elects to utilize the town’s water utility at any time after the date which is one month after the town has sent notice to the owners that they may elect to utilize the town’s water utility, said owner shall pay, in addition to all other rates and charges, a surcharge in the amount of $1,170 plus interest thereon at the rate of 5% per annum from the date which is one month after the town has sent notice to the owners that they may elect to utilize the town’s water utility through the date that the surcharge is paid in full; or
   (B)   (1)   A monthly surcharge in the amount of $7.72 (“monthly surcharge”), which monthly surcharge shall commence on the date which is one month after the town has sent notice to the owners that they may elect to utilize the town’s water utility, and shall be paid for a period of 240 consecutive months (the “payment period”). In the event an owner elects to utilize the town’s water utility at any time after the date which is one month after the town has sent notice to the owners that they may elect to utilize the town’s water utility, said owners shall be required to:
         (a)   Commence and continue to pay the monthly surcharge through the remainder of the payment period; and
         (b)   Immediately pay the sum of all monthly surcharges which accrued between the date which is one month after the town has sent notice to the owners that they may elect to utilize the town’s water utility and the date on which the owner’s lot, parcel, or building is connected to the town’s water utility, plus interest on said sum at the rate of 5% annum on said sum accruing from, and after, the date which is one month after the town has sent notice to the owners that they may elect to utilize the town’s water utility up to, and including, the date of the payment made for this arrearage.
      (2)   In the event the owner makes payments under division (B)(1)(b) above and subsequently desires to retire the remaining balance of the surcharge, said owner shall pay the amount which is set forth in an attachment to the ordinance contained in this section based on the month in which the remaining balance will be paid in full.

§ 50.99 PENALTY.
   (A)   Any person violating any provisions of this chapter, for which no specific penalty is prescribed, shall be subject to § 10.99.
   (B)   Any user who violates §§ 50.19 or 50.20 may be punished by a fine of not more than $2,500 (see I.C. 36-1-3-8 (10)). Each day of violation shall constitute a separate offense. In addition to, or in the alternative to, a fine, water service may be terminated for any user who violates §§ 50.19 or 50.20.

   (C)   If bills for the services rendered in §§ 50.35 through 50.39 are not paid within 17 days of the due date, a penalty of 10% shall be imposed.
