§ 90.99 PENALTY.
   (A)   Any person violating any provisions of this chapter, for which no specific penalty is prescribed, shall be subject to § 10.99.
   (B)   In addition to any other remedy provided in §§ 90.01 through 90.05(A), or under any applicable law, any person or persons violating any provision of §§ 90.01 through 90.05(A) shall be punished by a fine not to exceed $1,500. Each day’s continued violation shall constitute a separate offense.
   (C)   (1)   Any person who violates the provisions of §§ 90.05(B) through 90.08 shall be subject to the following fines (escalating fines shall be measured on a calendar year basis):
         (a)   First offense: $1,000;
         (b)   Second offense: $1,500;
         (c)   Third offense: $2,000; and
         (d)   Subsequent offenses: $3,000.
      (2)   Each day a violation occurs shall constitute a separate offense.
      (3)   Enforcement of first offense within a calendar year shall be within the jurisdiction of the town.
      (4)   All enforcement of offenses subsequent to the first offense within a calendar year shall be within the jurisdiction of the town.
      (5)   A custodial parent shall be responsible for ensuring that any child under 18 years of age is responsible for any fine imposed.
      (6)   Citations for violation of §§ 90.01 through 90.08 may be issued by any sworn member of the town, the Town Marshal, designated town employees, or by any sworn special police officer.
   (D)   The penalty for violation of § 90.09 is a fine of $50 per each occurrence.
   (E)   Any person, persons, firm, or corporation who violates §§ 90.20 through 90.22 shall be fined not less than $50. All fines are to be assessed by, and made payable to, the town. All monies collected under §§ 90.20 through 90.22 shall be deposited into the fund of the town.
