925.04 MAINTENANCE OF EXISTING SEWER LINES.
   (a)   Maintenance Responsibility. The property owner/renter within the Village limits is responsible for the maintenance and cleaning of the private sewer lateral from the building structure to the Village sewer main including the wye pipe connection or tee connection at the sewer main. Laterals must be kept free from roots, grease deposits, and other solids that may impede flow or obstruct the transmission of waste. All pipes and joints must be tight, sound, and free from structural defects (such as cracks, breaks, and missing portions) to prevent root intrusion, waste exfiltration, or infiltration of groundwater or storm water.
   The Village is responsible for the proper maintenance and operation of the main sewer lines, manholes, pump stations, and the wastewater treatment facilities.
   (b)   Acts of God.
      (1)   The Village is not responsible for any sewer backups that are on the service or main lines and that are under the definition of “Acts of God”, as set forth in subsection (b)(2) hereof.
      (2)   “Acts of God” shall be defined for purposes of this section as follows: heavy rainfall, debris blockage, tree root intrusion, water line ruptures, unknown storm sewer cross connections, and similar events.
   (c)   Prohibited Connections. No drains or other appurtenance that collect storm water or surface should be connected to sewer lines.
   (d)   Notice of Violation. Whenever the Village Administrator or his/her Designee finds that any user has violated or is violating this Section 925.04, the Village Administrator may serve on the user a written notice of violation. Within thirty (30) days of the receipt of such notice the user must submit to the Village Administrator an explanation of violation, a plan and timeline for satisfactory connection and further prevention, including specific required actions. Submission of this plan in no way relieves the user of liability for any violations occurring before and after the required actions have been taken.
