Upon proper application, payment of the required fee, and action by City Council, a permit may be issued. Each permit issued shall describe clearly the place of business for which it is issued and shall be non-assignable. All permits expire on June 30 of each year.

No person shall sell, give or otherwise supply any tobacco, tobacco products, alternative nicotine products, vapor products, or cigarettes to any person under 21 years of age.

Any sales of tobacco, tobacco products, alternative nicotine products, vapor products, or cigarettes made through a cigarette vending machine are subject to rules and penalties relative to retail sales of tobacco, tobacco products, alternative nicotine products, vapor products, and cigarettes provided for in Iowa Code § 453A.36.

(A)
Following a written notice and an opportunity for a hearing, as provided by the Iowa Code, the Council may revoke a permit issued pursuant to this chapter for a violation of Iowa Code Chapter 453A, or any rule adopted thereunder.
(B) If a permit is revoked, no new permit shall be issued to the retailer or for the place of business for one year after the date of revocation unless good cause to the contrary is shown to the Council.

A permit may be issued to an applicant for a business described in § 111.02 only if the business is located in a zoning district, (Chapter 160), where such use is permitted, the applicant is a person of good moral character, and the applicant has not been found guilty of a violation of Iowa Code Chapter 453A or this chapter.

(A)
Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(2) The Clerk shall give ten days’ written notice to the retailer by mailing a copy of the notice to the place of business as it appears on the application for a permit. The notice shall state the reason for the contemplated action and the time and place at which the retailer may appear and be heard.
