(a) Promotional Examinations in Police and Fire Divisions. Promotion to positions above the rank of fireman in the Fire Division and patrolman in the Police Division shall be by successive ranks as far as is practicable. Promotions within the Fire Division and Police Division shall be by competitive examination. For the purposes of this section, two or more persons who are eligible are required to take the promotional examination for the examination to be deemed competitive. When there are not two eligible persons to take the examination in the next rank lower than the position sought, the examination shall be opened to successive lower ranks until there are two or more eligible persons to take the examination, except that no person shall be eligible to take a promotional examination, other than the Chief, in either the Police Division or the Fire Division, unless he has three years' service in his department. For the position of Chief of the Fire Division and Chief of the Police Division the Mayor may nominate two additional qualified persons to take the promotional examination in addition to those members of his respective divisions who are otherwise eligible. Except for the position of Chief in the Fire Division and Chief in the Police Division, no promotional position in either division may be filled by original appointment. An assessment board may be used to select the person to be promoted or appointed to the position of Chief of the Fire Division or Chief of the Police Division. Selection of such board shall be by the Commission.
(b) Promotional examinations in the classified service shall be administered by a qualified testing service as provided in Section 149.04.
