There is hereby adopted, and incorporated by reference as if set out by length herein, for the purpose of establishing standards for the location, design, equipment, use, occupancy and maintenance of one, two and three-family dwellings and appurtenant structures, that certain code known as the Residential Code of Ohio (One, Two, and Three Family Dwelling Code), 2004 Edition, as published by the Ohio Building Officials Association, subject to the modifications provided in this chapter.

A copy of the Residential Code of Ohio as adopted herein, is on file with the Building Commissioner and in the County Library. The Commissioner also has copies available for distribution to the public at cost.

Whenever the following terms are used in the Residential Code of Ohio as adopted herein, they shall have the meanings respectively indicated:
(a) "Building Official" means the Building Commissioner and Assistant Inspectors.

The Residential Code of Ohio, as adopted herein is modified by the amendment, enactment, or deletion of the following sections as respectively indicated, which modifications to the Residential Code of Ohio are hereby adopted as set forth herein:
Sec. 103.1 APPLICATION (Added).
The scope of the application of this code shall extend to three family structures.
Sec. 105 ENTRY (Added).
If such permission is refused or is otherwise unobtainable, a search warrant must be obtained before such entry or inspection is made, except in the case of an existing emergency which includes, but is not limited to, fire, flood, man-made or natural disaster when entry may be made at any time and no search warrant is necessary. No person shall refuse to permit such emergency entry or inspection, nor shall any person hinder, obstruct, resist or abuse any building official making or attempting to make such entry or inspection.
Sec. 106.4 PENALTY (Amended).
The word "misdemeanor" shall be replaced with "misdemeanor of the first degree and shall be subject to the penalty provided in Section 1420.99 of the Codified Ordinances of University Heights."
Sec. 118.1 1 GENERAL (Added).
Any owner, agent or other person who fails to stop work within a reasonable period of time after being served with a written stop work order, may be issued a citation to appear in front of a court of competent jurisdiction. Any owner, agent, or person continuing to work after receiving a citation may be subject to arrest.
Sec. 326 ACCESS AND PRIVACY (Added)
Sec. 326.1 HABITABLE ROOMS AND BEDROOMS.
Each habitable room shall have access to each other habitable room or to a bathroom or a lavatory without passing through a bedroom. Each bedroom shall have access to a bathroom or lavatory without passing through another habitable room.
