§ 33.30 COMPOSITION.
   (A)   The Fire Chief shall exercise control and supervision over the duties and activities of the Fire Department. He shall be appointed by the Mayor and paid a salary as set by Common Council. For all purposes of law, the Fire Chief shall be conclusively deemed to be a member of the fire force.
   (B)   Regular members of the Fire Department shall be employed by the municipality. Such regular firefighters shall be and remain on duty at the Fire Department headquarters in compliance with instructions from the Chief. (Ord. 1230, passed 5-19-31)

§ 33.31 BADGES.
   All firefighters shall have badges designating them as such and denoting their position on the fire force. They shall be worn in a conspicuous place during a fire and when on duty.

§ 33.32 EQUIPMENT.
   (A)   The members of the Fire Department shall be equipped with such firefighting clothing as may be deemed necessary by the Board of Public Works and Safety. All equipment shall remain the property of the municipality.
   (B)   All equipment to be used shall be furnished by the municipality. ('74 Code, § 33.02 (A), (C)) (Ord. 1109, passed 6-5-22)
§ 33.33 (RESERVED).
§ 33.34 DISTRIBUTION OF BENEFITS FROM FIRE FIGHTERS PENSION FUND.
   A participating member of the Fire Department or his or her family shall receive temporary disability benefits, permanent disability benefits, death benefits, survivor's benefits, and any other benefit as specifically defined in IC 36-8-7. This section shall not apply to benefits for surviving spouses of fire fighters covered under the 1977 Police Officers' and Fire Fighters' Pension and Disability Fund set out in IC 36-8-8 or any amendments thereto.
