743.05 MOBILE FOOD VEHICLE LOCATION AND OPERATION.
   (a)   No person shall operate a Mobile Food Vehicle within the City of Twinsburg unless they have first obtained a permit therefore and are operating in conformance with these regulations.
   (b)   Persons conducting business from a mobile food vehicle on public or private property may conduct such business only in compliance with the following:
      (1)   They must provide to the City a copy of a lease or the written expressed consent from the property owner to use the business property on which they propose to operate or enter into a written agreement with the City if the property location is on publicly owned property.
      (2)   Mobile Food Vehicles may only be located in commercial districts in the City as set forth in the Planning and Development Code and are prohibited in residential and industrial districts unless approved as a Special Event pursuant to Section 743.06.
   (c)   Persons conducting business from a mobile food vehicle shall not be permitted to operate in the following manner:
      (1)   Vending may not obstruct the use of any street intersection or pedestrian crosswalk.
      (2)   Vending shall not impede the ingress or egress of any driveway.
      (3)   Vending shall not obstruct pedestrian space.
      (4)   Vending structures shall not be left unattended or stored at any time on the open vending site when vending is not taking place or during restricted hours of operation.
      (5)   Amplified sound or sound equipment or visual attractions such as balloons, streamers or flags or similar items is prohibited and shall not be used to draw attention to the Mobile Food Vehicle.
      (6)   Any and all signage must be contained on the mobile food vehicle or private property. At no time shall any signage be placed within the public rights-of-way or in violation of the City's sign ordinance.
      (7)   No mobile food vehicle operator shall provide any dining area, including but not limited to, tables, chairs, booths, bar stools, benches, counters, unless a proposal for such arrangements is submitted with the permit application and approved by the City
      (8)   Vendors shall be prohibited from travelling and operating in multiple locations in the City during any twenty-four (24) hour period unless approved by the City.
   (d)   All mobile food vehicle operators are subject to the regulations and other requirements established by the Summit County Health Department.
   (e)   Hours of operation shall be limited and designated by the City and vendors shall be allotted thirty (30) minutes set-up and thirty (30) minutes breakdown before and after the stated operating hours.
   (f)   Unless specifically authorized as part of a special event pursuant to Section 743.06 below, no mobile food vehicle shall be located within five hundred (500) feet of the front door of any existing food establishment. Distance shall be measured from the mobile food vehicle to the nearest entrance for any food establishment.
   (g)   It shall be unlawful to operate a mobile food vehicle in or within one hundred fifty (150) feet of any Primary or Secondary School. Distance shall be measured to the nearest lot line of the school's campus.
   (h)   The permit shall be subject to additional limitations on hours and days of operation that the City determines are appropriate to prevent conflict with special events. Examples of special events include, but are not limited to, construction, parades, sponsored City events and street closures due to licensed events.
   (i)   A mobile food vehicle may use battery or generator-operated lights with appropriate protective shields for the purpose of illuminating merchandise, so long as it is not a distraction to passing motorists. The decision of such distractions shall be determined by the Twinsburg Police Department.
   (j)   No mobile food vehicle operating within the city shall cause congestion that impedes pedestrian or vehicle traffic or interfere with the City or public's use of any public rights-of-ways. This shall include but is not limited to activity of customer queues, accessory units, or signage that in any way invades or impairs access to adjacent parking, pedestrian or vehicle traffic.
   (k)   No mobile food vehicle shall make or solicit any sales to occupants of vehicles or engage in any activities which impede vehicular traffic.
   (l)   Mobile food vehicles shall be responsible to provide and maintain their own trash receptacles. Operator shall contain all refuse, trash, and litter within the mobile food vehicle or a small moveable trash can maintained by the operator, and located adjacent to the mobile food vehicle in such a manner as not to block or otherwise obstruct pedestrian or vehicular traffic. The operator of the mobile food vehicle shall be responsible for properly disposing of such refuse, trash, and litter as would any business, and shall not place it in any public trash container, or in any private container without proper permission.
   (m)    Mobile food vehicles shall be responsible for proper disposal of waste water and shall be prohibited from discharging any waste water onto the ground or into storm sewers.
   (n)   The proposed mobile food vehicle vending activity shall be responsible for complying with all applicable laws including but not limited to the Americans with Disabilities Act.
   (o)   Pushcarts shall have overhead protection, such as an umbrella, to cover the food area.
   (p)   No mobile food vehicle shall have a drive-through service.
   (q)   The decibels levels for any generator(s) used shall not exceed "80dBA". The operator shall provide the manufacturer's specs on decibels range generated by his particular generator.
   (r)   Any mobile food vehicle being operated without a valid permit issued by the City shall be deemed a public safety hazard and may be ticketed and impounded.
   (s)   A mobile food vehicle operating at any unauthorized location or beyond the hours for which the operation has been permitted shall be deemed operating without a permit in violation of this section and may be subject to enforcement.
   (t)   Comply with all requirement of applicable state and local law, including fire prevention codes of the City of Twinsburg and State of Ohio, the Ohio Uniform Food Safety Code, and the City's traffic and parking regulations.
   (u)   Unless specifically authorized as part of a special event pursuant to Section 743.06 below, a mobile food vehicle shall not be operated on the same lot, parcel, or location for more than five (5) calendar days in any one (1) calendar month, regardless of the actual length of time that the mobile food vehicle is operated on the lot, parcel, or location in any one (1) calendar day.
   (v)   No mobile food vehicle shall be parked or stored on any lot, parcel, or street between the hours of 10:30 p.m. and 6:30 a.m. unless such parking or storage is within an enclosed structure. No mobile food vehicle shall be left unattended and/or unsecured at any time on any lot, parcel, or location within the City. Any mobile food vehicle which is found to be unattended or parked or stored in violation of this Section shall be considered a public safety hazard and may be ticketed and impounded. (Ord. 73-2023.
