743.06 MOBILE FOOD VEHICLES FOR SPECIAL EVENTS.
   (a)   It is the intent of this section to establish regulations to allow mobile food vehicles the opportunity to serve specific Special Events on public and/or private property and rights-of-way for a limited and designated periods of time. At its discretion, the City may designate specific locations where and when the timing and place of said activity does not conflict with the City's desire to protect the safe and convenient use of public rights-of-way and public property. It is the City's intent to control pedestrian and street congestion as it relates to the operation of mobile food businesses and the proximity to established brick and mortar businesses. Special Event permits may be used to establish a temporary food zone associated with a public event to be conducted on public sites with specific hours of operation in support of those events. Any licensed and inspected Mobile Food Vendor may apply to be included as a vendor for a particular time period during the event. The City will select vendors from a current list of approved and inspected vendors. Should more vendors apply than can be accommodated the City will select vendors by drawing or other methods.
         
   (b)   Mobile Food Vehicles may be approved for Special Events in Residential and Industrial Districts under the following restrictions:
      (1)   Dispensing of food or beverages is limited to eight (8) hours;
      (2)   Sales or dispensing of food and beverages are restricted to the owners, occupants, guests or employees associated with the private property upon which the owner's consent has been granted or for attendees of the Special Event..
      (3)   Mobile food vehicles shall not sell or dispense food or beverages to the general public.
      (4)   The business use being served must be a use that is otherwise allowed within the zoning district in which the vendor proposes to operate.
   (c)    To participate in a Special Event, the mobile food vendor must make application for the location and/or specify the special event which will be served, as well as the dates and hours during which they wish to operate.
   (d)    The Special Event vending permit shall be issued under the following conditions:
      (1)   The applicant must first possess a current Mobile Food Vendor or Pushcart Permit as set forth herein.
      (2)   An application must be submitted to the Building Division of the City of Twinsburg where it will be reviewed at least ten (10) working days prior to the event.
      (3)   It shall be unlawful to leave any mobile food vehicle unattended on public rights-of-way, or to remain on public rights-of-way outside of the allowed hours of operation.
      (4)   No mobile food vehicle vending within the City's rights-of-way shall operate within five hundred (500) feet of any fair, stadium, carnival, circus, festival, special event, civic event, entertainment district or other like sponsored event that is licensed or authorized by the City, unless they are authorized by the sponsor to be participants in such event.
      (5)   Any power required for the mobile food vehicle located on a public way shall be self-contained. The mobile food vehicle shall not draw its power from the public rights-of-way. No power cable or equipment shall be extended at grade or overhead across any public street, alley or sidewalk.
      (6)   Mobile food vending in the rights-of-way shall only occur from the side of a food vehicle that is parked abutting and parallel to the curb unless the street has been closed for the event.
      (7)   No mobile food vehicle shall be parked on the street overnight, or left unattended and unsecured at any time. Any mobile food vehicle which is found to be unattended shall be considered a public safety hazard and may be ticketed and impounded.
      (8)   The Safety Director shall, in the best interest of the City, maintain the authority to regulate uses of the public rights-of-way and public property and may modify, terminate, create, or reduce the size and/or location of a food zone at a later date.
      (9)   The Special Event permit shall be subject to the Rules and Regulations of the primary permit issued.
