339.02 USE OF NON-INTERSTATE OR NON-STATE ROUTES LOCATED WITHIN THE MUNICIPALITY; LOCAL PERMIT AND CONDITIONS.
   (a)   Use of Non-Interstate or Non-State Routes. No person shall operate a vehicle classified as a Class 6 or higher vehicle by the Federal Highway Administration (FHWA) upon any street in the Municipality, other than an Interstate route or State route, except those streets designated as through traffic routes for such vehicles and marked as such by appropriate traffic signs, and except when such operation is necessary to load or unload property, to go to or from the usual place of storage of such vehicle or to perform any other legitimate business or act other than passage through the Municipality. Vehicles so deviating from an Interstate route, a State route, or a designated through traffic route for vehicles FHWA Class 6 or higher within the Municipality shall confine such deviation to that required in order to accomplish the purpose of the departure.
   (b)   Local Permit and Conditions. Upon application and for good cause, the Mayor may issue a local permit authorizing an applicant to move an oversize or overweight vehicle or combination of vehicles upon non-Interstate or non-State Route streets within the Municipality.
   No applicant that has been issued a permit hereunder shall be required to obtain a special permit from the Ohio Director of Transportation for the movement of the vehicle or combination of vehicles on streets or highways under local jurisdiction; however, the approval of the Ohio Director of Transportation shall be required for movement upon State routes as provided in Section 339.01. The Mayor may grant a permit for a single or round trip, or for such period of time, not to exceed one year, as the Mayor in his/her discretion deems advisable, or for the duration of any construction project. The City may limit or prescribe terms or conditions of operation for such vehicle or combination of vehicles by designating the route, hours, speed or such other restrictions as may be necessary for the preservation of the public peace, property, health and safety. The City may require the posting of bond or other security necessary to compensate for any damage to a roadway or road structure.
   For each permit, the City shall charge two-hundred fifty dollars ($250.00), and for each hour of time or any part thereof spent by the Police Department in supervising the movement of such vehicle, the applicant shall pay the sum of thirty-five dollars ($35.00) per police officer engaged for such work.
   Streets or highways under local jurisdiction shall be posted with signs indicating "no thru trucks" or words of similar import to apprise drivers of the limitations imposed by this section. No driver shall disobey the instructions indicated on any such sign.
   Violation of any of the limitations, terms or conditions of the permit granted by the Mayor shall be cause for immediate revocation or suspension of such permit, and denial of request for any future permit. Such violation shall also subject the violator to the penalty prescribed by Section 303.99.
   (c)   Through traffic by vehicles classified as a Class 6 or higher by the Federal Highway Administration is hereby prohibited upon Cannon Road, Post Road, Glenwood Drive; Ravenna Road between Miktarian Parkway and SR 91and Chamberlin Road between its intersections with Ohio Route 82 and Ravenna Road regardless of the load capacity of such vehicles. The Director of Public Safety is hereby authorized and directed, acting pursuant to Sections 305.02 and 305.04 of the Codified Ordinances, to post signs at various locations giving notice of this enactment, and the sworn-officers of the Police Department are authorized to issue citations pursuant hereto with Cannon Road, Post Road, Glenwood Drive; State Route 91; Ravenna Road between Miktarian Parkway and Chamberlin Road between its intersections with Ohio Route 82 and Ravenna Road being restricted routes to through truck traffic. Nothing herein shall prohibit vehicles classified as a Class 6 or higher by the Federal Highway Administration from transacting business upon Cannon Road, Post Road, Glenwood Drive and State Route 91 and Chamberlin Road between its intersections with Ohio Route 82 and Ravenna Road or from operating thereupon as the same has previously been defined herein.
   (d)   Whoever violates Section 339.02(a) shall in addition to being guilty of a minor misdemeanor shall be fined as provided in Section 339.01(c) if the weight of the vehicle and load exceeds the maximum specified in Section 339.01.
