1365.02 APPLICATIONS AND ISSUANCE.
   (a)   Application for a Certificate of Occupancy permit required by the provisions of this chapter shall be made by the owner, or an agent for the owner, upon forms provided by the Division of Building. The owner or occupant shall upon written request permit the Housing and Zoning Inspector or any authorized Building Inspector of the Division of Building access to real property upon request during the hours of 9:00 a.m. to 6:00 p.m. Monday through Saturday of each week, excepting legal holidays, for the purpose of making the exterior inspection of the land, building or structure. The failure to allow access to real property for exterior inspection during the periods provided for herein and upon identification of the Inspector(s) shall be deemed a violation of this chapter.
 
   (b)   The following schedule of issuing a Certificate of Occupancy permit shall be followed, except where a longer period is required because of causes beyond the control of the City:
      (1)   Within five working days after receipt of the application and required fee, the Housing and Zoning Inspector or any authorized Building Inspector of the Division of Building shall cause an exterior inspection of the designated property to be made.
      (2)   The Building Commissioner shall then issue a Certificate of Occupancy permit within five working days after gaining access to the subject property containing the following information:
         A.   The street address, permanent parcel number, or other identifying characteristics of the property;
         B.   The name and address of the owner, as defined in this Title of the Codified Ordinances;
         C.   The authorized use and occupancy of the buildings, structures or premises;
         D.   The list of violations of the Maintenance Standards, Chapter 1313 of the Codified Ordinances existing at the time of such exterior inspection.
 
   (c)   Except in the case of danger to the public health or safety, the exterior inspection report correction order shall contain the order of the Housing and Zoning Inspector for the correction of any Code violations noted on the letter, which shall be corrected by the owner of the property within ninety days of the issuance of the correction letter unless, for good cause shown, the Housing and Zoning Inspector has extended that time for compliance.
 
   (d)   If the owner of a property does not comply with the violations enumerated in the exterior inspection report correction order prior to the time the title is transferred to the purchaser, then the purchaser of the property will be required to comply with the violations contained in the exterior inspection report correction order within the time allotted in the notice given to the prior owner as that time may be extended by the Housing and Zoning Inspector.
 
   (e)   If pursuant to Section 1365.02 (d), the title to the property is transferred prior to the violations in the exterior inspection report correction order having been corrected to the City's satisfaction, there shall be deposited in escrow, with the escrow agent prior to transfer, a written statement agreed to by the owner and purchaser setting forth their respective responsibilities for correcting the violations in the exterior inspection report correction order which remain uncorrected and setting forth the sum of money which the owner and purchaser deem sufficient to correct their respective violations.
 
   (f)   Nothing in this chapter shall be construed as limiting the City, at any time from proceeding against the current owner of record to require corrections of code violations.
 
   (g)   Such Certificate of Occupancy permit shall be valid for a period of one year from the date of issuance, unless an extension is approved by the Housing and Zoning Inspector. In case of resale within the one year period, this Certificate shall be transferred to any subsequent bona fide purchaser and shall be valid for the remainder of that period.
