(a) Community antenna television systems are hereby declared and recognized to be public utilities when operated or when such operation is contemplated within the Municipality. "Operation" means any system for the transmission, amplification, receipt, reproduction, projection or creation of a television picture or image within the Municipality and shall include all conduits, wires, electrical transmission or reception devices, fixed antenna and transmitter locations, electrical generating equipment and any and all other equipment appurtenant to the television industry.
(b) Any person operating or attempting to operate such a community antenna television system shall obtain a franchise for such utility operation from Council, subject to such reasonable regulations for the operation of such utility as may be imposed by Council, in consideration of the recommendations of the Planning Commission pursuant to Section 903.02.
