521.06 DUTY TO KEEP SIDEWALKS IN REPAIR AND CLEAN.
   (a)   No owner or occupant of abutting lands shall fail to keep the sidewalks, curbs or gutters in repair and free from snow, ice or any nuisance. (ORC 723.011)
   (b)   No person shall place or deposit snow or ice collected from sidewalks, driveways or any other private property onto a street or sidewalk.
   (c)   No person shall dump, discharge, sweep or otherwise deposit grass, yard or lawn clippings onto any public street.
   (d)   It shall be the duty of the Director of Public Service and Safety of the City of Troy, Ohio to provide for enforcement of the provisions of this chapter by designating City employees to issue civil penalties and perform other duties as directed by him.
   (e)   Whoever violates Section 521.06(a), (b) or (c) shall present such notice, as set forth in Section 521.06(f) at the Police Department of the City of Troy, Ohio, and pay the sum of twenty dollars ($20.00) in full satisfaction of such violation if paid within ten calendar days after the time of violation. If ten calendar days have passed since the time of the violation, the violating individual shall present such notice at the Police Department of the City of Troy, Ohio, and pay the sum of fifty dollars ($50.00) in full satisfaction of such violation.
   (f)   Whenever a designated City employee determines that there is a violation of this section, notice shall be provided to the violator and set forth the date of the offense, a statement of facts describing the violation, and notice of the procedures for satisfying the civil penalty and an appeal hearing. Said notice shall be served by personal service, regular mail, or certified mail.
   (g)   A person may request a hearing upon notice of a violation of this section by submitting a written request setting forth these grounds disputing the violation to the office of the Director of Public Service and Safety within fourteen days after the service of such notice. Upon receipt of the request for hearing, a hearing shall be scheduled and notice provided to the person requesting the hearing. The Director of Public Service and Safety is authorized to appoint a Hearing Officer.
   (h)   The Hearing Officer shall set and conduct an administrative hearing within fourteen days of a request for a hearing, except the time of the hearing may be extended for good cause. The Hearing Officer shall keep a record of all proceedings.
   (i)   The Hearing Officer shall afford the person a reasonable opportunity to present witnesses and evidence. The Hearing Officer shall establish the necessary rules and regulations regarding the conduct of such hearings.
   (j)   The Hearing Officer shall determine whether the violation occurred and the decision of the Hearing Officer shall be a final decision of the City. Should the Hearing Officer determine that the person violated this section, the person shall have ten days to pay twenty dollars ($20.00) as a civil penalty to the City of Troy, at the Police Department of the City of Troy, Ohio. If the person does not pay twenty dollars ($20.00) within ten days of the decision of the hearing officer, the person shall be obligated to pay fifty dollars ($50.00).
