1303.04 INSPECTIONS AND FEES FOR INSPECTIONS; PLAN EXAMINATIONS AND PERMITS.
   (a)    Inspections. Prior to concealing or using any assemblage, the Enforcement Officer shall, upon twenty four hours advance notice and in the presence of the owner or his duly authorized representative, inspect the building, including but not limited to, all installations, use, materials, and assembled manufactured products, pertaining to the approved plans or relative to a required permit. Such inspections will be made to assure compliance with all laws, regulations and ordinances applicable to the same.
   (b)    Plan Examination, Inspections and Permit Fees. The bui1ding, mechanica1, electrical and fire protection permit fees shal1 be paid for al1 work regulated by this Codified Ordinance and shall be calculated by adding the processing fee, plan examination fee, and inspection fee for each item as shown in the Fee Tables. Fees for customary building and fire protection inspections are included in their respective processing and plan exam fees, whereas the electrical and mechanical inspection fees are charged in addition to their processing and plan exam fee as noted in Notes 2 through 4, Table 1303.04(d). All fees contained in the permit fee tables, including double fees imposed according to Section 1303.04(i) shall be paid to the City for deposit to the general fund upon the filing of an application for permit as required. Failure to be charged the full amount at time of application will not validate an error or omission that may have been made by the City in calculating the permit fees. Though every effort is made to quote an accurate fee, there may have been inaccurate information, obscured floor areas or hidden work that wasn't noticed at time of application but later discovered during the actual plan examination.
    All fees shall be paid prior to release of any permit.
      (1)   Permit fee/tables. Whenever a permit is required for work regulated by the State or Local Code adopted in Section 1303.01, the permit fee for a building, mechanical, electrical or fire protection permit shall consist of a plan exam, processing and inspection fee for each type of permit applied for. The most applicable of Tables 1303.04(d) through (g) will be used to assess the plan exam/processing fee and the inspection fees will be assessed in accordance to Table 713.13(b) for electrical work and Table 727.13(b) for mechanical work. Inspection fees for building and fire protection permits are included in the plan exam/processing fee charged for such permits.
         A.   A local plan exam/processing fee will not be charged for the mechanical or electrical work if such work is related to an outstanding “building” permit which has been issued by the City of Troy for one, two or three family structure regulated by local codes. Once the work associated with the “building” permit has been completed, the permit is no longer outstanding and a 1ocal plan exam/processing fee will be charged for each type of plan identified in Table 1303.04(f) or Table 1303.04(g), whichever is most applicable.
         B.   When Local or State Regulated building, mechanical , electrical or fire protection work is for the repair, replacement, alteration, relocation , addition, reconstruction, or for the incidental upkeep to maintain the existing building, structure or service equipment, the Troy Chief Building Official shall be notified and shall determine whether or not a permit or plan review is required. If required, the Troy Chief Building Official shall apply local plan exam/processing fees as stated in subsection (b)(1)A hereof or State plan exam/processing fees in accordance with Table 1303.04(d) through (e), whichever is most applicable.
   (c)    Inspection, Reinspections and Special Inspections. No regular inspections will be performed until the permit fees are paid and the permit approved. A reinspection fee as noted in the Fee Tables will be assessed whenever the customary inspections noted on the permits have been exceeded and a second reinspection is made. Each request for special inspections must be considered separately because such inspections are not necessary to assure compliance to current permits nor are permits required to perform such inspections. If such a request is granted, a special inspection fee will be assessed for each inspection as noted in the Fee Tables. No regular or special inspection will be performed until all fees are paid.
   (d)    State Fees; New Work. The fees for inspection of plans and specifications required to be submitted for approval under the state code adopted in Section 1303.01 relative to new buildings or structures, additions or the placement of industrialized units shall be per Table 1303.04(d). The permit fee as identified in subsection (b) hereof shall be based on the gross floor area of each floor level under consideration and shall be collected for each item mentioned in the Table. See subsection (I) hereof relative to work without a permit.

The fees shall be applied separately and accumulatively to each floor level having the type of plans or feature shown in Table 1303.04(d). The permit fee as identified in 1303.04(b) shall be based on the gross floor area of each floor level under consideration. For area of additions not included in previous plan examinations, the fees shall be in accordance with Sections 1303.04 and 1303.04(d). See Section 1303.04(i) relative to work without a permit.

This might include the construction or alteration of towers, sub-floors, fire doors, crane rails or any structure, equipment, or type of work not customarily tabulated or associated with “floor area”. See Section 1303.04(e) Notes 1 and 2 for items specifically identified and Section 1303.04(i) relative to work without permits.

Note 1:    The term "value of work" as used in this Table, means the fair market value of all services, labor and materials used. Services, labor, or materials donated or performed at cost will be subject to the same fair market values as work done for profit.

   (h)    Change of Use Fees. When the change of use in any building or structure does not require permits for work identified above, but still requires a plan review for a Certificate of Occupancy, a fee for review, processing and inspections shall be assessed for each floor level requiring the review. Such fee shall be ten dollars ($10.00) plus one dollar ($1.00) per 100 sq. ft. or part thereof for each type of plan or feature reviewed and identified in Table 1303.04 (d). The fees shall be based on the gross floor area of each floor level under consideration.
   (i)    Work Started Without Permits. An additional fee equal to one hundred percent (100%) of the plan exam, processing and inspection fee assessed according to the Tables above shall be paid by the owner when such work is started before a permit is secured unless such work is done as an emergency measure to temporarily abate the imminent hazard until the required information can be submitted for approval and permit(s). The payment of such additional fee shall not relieve any person from fully complying with the requirements of the code nor from the inspections required to determine compliance therewith.
   (j)    Refunds. In the case of revocation of a permit or abandonment for discontinuance of a building project, that portion of work actually completed by the jurisdictions shall be computed and any excess fee for the incomplete work shall be returned to the applicant upon written request. However, fees to be refunded shall not include any processing or penalty fees. All plan examination, processing, and inspection fees and all penalties that may have been imposed on the applicant under the requirements of this code shall first be collected before computing excess fees.
   (k)    Time Limit of Application. An incomplete application for a permit for any proposed work shall be deemed to have been abandoned six months after the date of filing, unless such application has been diligently prosecuted or a permit shall have been issued; except that the Troy Building Official shall grant one or more extensions of time for additional periods not exceeding ninety days each if there is reasonable cause.
   (1)    Suspension of Permit. For any proposed work requiring a permit anywhere within the Codified Ordinances, the permit shall be subject to the same expiration provisions and renewal fee found in Section 1133.041 of this Codified Ordinance except that work regulated by state codes shall be subject to OAC Rule 4101:2-1-23 (F) found in the Ohio Basic Building Code.
   (m)    Special Services. A fee of forty dollars ($40.00) per hour will be assessed for the excessive review of preliminary plans submitted for evaluations; or for the special evaluations of products, materials or methods which require the conditions of acceptability to be defined for applicable code(s); or for other services not provided for elsewhere and involving unusual requests which may serve as a convenience to one but by its nature imposes an excessive or unusual hardship on the standard operating procedures of the department.
