915.10 SCHEDULE OF RATES AND CHARGES.
   (a)    The following rates are hereby established, applicable to Section 915.08, creating a sewer service charge and Section 915.09, creating a schedule of fees and charges.
   (b)    The minimum charge shall be based on the size of the water meter used to serve the premises. Such minimum service charge shall include the first 200 cubic feet of usage based on water used each month. (Ord. 2-00. Passed 2-22-00.)
   (c)    The commodity charge shall be based on the quantity of water used on the premises served, as measured by water metering therein used, which metering shall be acceptable to the city, subject to Section 915.08.
The commodity charges shall be as follows for all bills due after January 1, 2023:

   (d)    The foregoing rate schedules shall be considered as the base rates for any lot, parcel of land, building or premises situated within the corporate limits of the City and having any connection with or accessible to the POTW or otherwise discharging sanitary sewage, industrial wastes, water or other liquids, directly or indirectly into the POTW.
   (e)    Maximum billings for sewer charges for individual residential units for the summer months of June, July, August and September will not exceed the average billing of such charges for the preceding eight months at the residential unit. An occupant shall have lived at such unit's location throughout said preceding eight month period to qualify for such summer average.
   (f)    For any lot, parcel of land, building or premises situated outside the corporate limits of the City and having any connection to the POTW or otherwise discharging sanitary sewage, industrial waste, water or other liquids, either directly or indirectly into the POTW, the minimum and commodity charges shall be determined in the same manner as set forth in Section 915.08, but the rates established in subsections (b) and (c) above shall be increased by twenty-five percent (25%).
   (g)    The charges pursuant to this chapter shall be collected by the Billing and Collection Office. The Director shall make and enforce such rules as may be deemed necessary for the regulation, collection, rebating and refunding of such sanitary sewer service charges. The charges shall be payable monthly at the end of the billing period at the same time as water bills. The period, within which payment shall be made in order to be classified as a prompt payment, shall be determined by the Director and shall be expressed through the rules which he is authorized by this chapter to make for the purpose herein. In addition to the charge determined according to the rates specified herein, a further charge of ten percent of such amount shall be added in each case of failure to make prompt payment and the total thus obtained shall be the sewer charge for late payment.
   (h)    A minimum charge shall be levied and assessed upon any lot, building or premises connected with the City sanitary sewer system. Should the measured service exceed the minimum quantity, the corresponding commodity charges shall be applied in addition to the minimum.
   (i)    Each charge levied by or pursuant to this chapter is hereby made a lien upon the corresponding lot, land or premises served by a connection to the POTW. If the same is not paid within ninety days after it is due and payable, it shall be certified by the Director to the County Auditor, who shall place the same on the tax duplicate of the County with the interest and penalties allowed by law and be collected as other taxes are collected.
   (j)    The funds received from the collection of the charges authorized by this section shall be deposited with the City Treasurer and shall be accounted for and be known as the Sanitary Sewer Fund and, when appropriated by Council, shall be available for the payment of the cost and expense of management, operation, maintenance, repair and improvement of the POTW. Any surplus in such fund shall be used for the payment of the interest on bonds issued and outstanding or which may be issued to provide funds with which to pay the cost of constructing, enlargement, or replacement of the POTW, and to retire such bonds when they mature.
   (k)    All government entities, as owners of benefitted property, shall pay for the use of the POTW, rates, charges and rentals as detailed above. (Ord. 2-00. Passed 2-22-00.)
   (1)    Any person who desires permission to connect to and use the POTW shall pay a connection or tap-in charge according to the following schedule:
      (1)    Each applicant for sanitary sewer service, other than an applicant for a replacement connection or tap, shall pay the City a sewer tap-in charge as provided by resolution from time to time.

      (2)    Any applicant whose property abuts an existing sanitary sewer line paid for by the City and which property did not participate in the cost of such facility shall pay an additional connection charge of one thousand dollars ($1000.00) per connection.
      (3)    There shall be no additional connection or tap-in charge for a replacement connection or tap. However, a permit shall be applied for and inspection of connections must be made by City.
      (4)    Applications shall be made to the Director according to such forms and with such information as shall be required by the Director. Applications can only be made and signed by a licensed master plumber.
      (5)    All connection charges paid shall be placed in the Sanitary Sewer Fund.
