(A) Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(B) (1) Any person who shall violate §§ 51.001 through 51.004 shall be liable, upon summary conviction for a first offense and upon summary conviction for each subsequent offense, to a fine of not less than $15 nor more than $25, together with costs of prosecution in each case. Each day that a violation shall continue shall be deemed and shall be taken to be a separate offense and shall be punishable as such.
(D) The borough may deny or discontinue, after issuing at least 30 days’ written notice, water service to any premises to which meters, backflow prevention devices or pressure control devices, or other appurtenances are not installed if required, not installed in accordance with §§ 51.045 through 51.048, and/or are not properly maintained in working order. Water service to such premises shall not be restored until the property owner has corrected or eliminated such conditions or defects in accordance with this division (D), and to the satisfaction of the Borough Engineer. Any person who shall violate §§ 51.045 through 51.048 shall be subject to a judgment not to exceed $1,000, plus the costs of remediation of any damage to the public water system, and any costs incurred by the borough, including fees for inspection and attorneys’ fees, in proceedings before the magisterial district judge of competent jurisdiction. Each day of noncompliance shall constitute a separate violation.
(E) Any person who violates or permits the violation of §§ 51.060 through 51.062 shall upon conviction thereof in a summary proceeding commenced before a district justice pay a fine prescribed by the borough, not exceeding $1,000 plus all court costs, including reasonable attorneys’ fees incurred by the borough. Each and every day during a violation of §§ 51.060 through 51.062 shall occur will constitute a separate violation.
