§ 51.062 DISCOVERY OF ILLEGAL CONNECTION.
   (A)   In the event that such inspection discloses an illegal connection to the collection system or other noncompliance with applicable borough ordinances or regulations, a written notice of such noncompliance signed by Council’s designated representative shall be posted conspicuously on the front door of the premises. A certified letter shall also be sent to the owner informing him or her of the observed violations. The current owner shall bear all costs for removal, remediation and/or abatement of any violation found and, if needed, bringing the premises into code compliance or regulations compliance. The owner of the premises shall have 60 days from receipt of the written notice to abate or remediate the violation.
   (B)   (1)   In the event that any such inspection discloses violations of the Borough Plumbing Code then in effect or applicable regulations, the owner of the property shall, at no charge, obtain a permit from the borough at no charge, and shall have required repairs commenced and completed by a licensed plumbing contractor within 60 days of the date of the notice that the inspection has disclosed such a violation.
      (2)   In the event that the owner of such property fails to commence and complete the repairs required to bring the property into compliance with applicable provisions of the Plumbing Code and regulations then in effect within 60 days of the date of notice, or fails to procure a permit, said property owner shall be required to obtain a permit at a fee of $50.
      (3)   In the event that the owner of such property fails to commence and complete the repairs required to bring the property into compliance with applicable provisions of the Plumbing Code and regulations then in effect within 120 days of the notice, or fails to said property owner shall be deemed to be in violation of the Plumbing Code and/or applicable regulations, and shall be subject to an enforcement action before the District Justice, and fines and/or penalties of not more than $1,000, plus court costs and attorneys’ fees, with each day constituting a separate ordinance violation.
