§ 150.04 UNSAFE BUILDING LAW.
   (A)   Adoption of the Unsafe Building Law. The town hereby adopts I.C. 36-7-9, which establishes the state’s Unsafe Building Law, and explicitly incorporates by reference, the definition of “substantial property interest” found in I.C. 36-7-9-2.
   (B)   Creation of the Department of Unsafe Structures. The town hereby establishes the Department of Unsafe Structures. The Town Manager shall serve as the chief administrative officer of the Department of Unsafe Structures. Other members of the Department shall be the Fire Chief and Clerk- Treasurer. The purpose of the Department will be to administer this section and ensure compliance with I.C. 36-7-9.
   (C)   Appointment of Department to administer section. The Department of Unsafe Structures shall be the executive department authorized to administer and enforce this section.
   (D)   Construction. Any reference to a state statute shall mean the statute as amended from time to time, or any similar statutory provision that may supersede it relating to the same or similar subject matter.
   (E)   Hearing Authority. The Town Board shall annually appoint an independent party, licensed to practice law in the state, as the Hearing Authority. No one who is employed by the Enforcement Authority may be designated as a Hearing Authority.
