GENERAL PROVISIONS
Each person residing in the city shall use closed garbage containers and/or closed plastic bags for garbage or trash pick-up, and request that homeowners set out garbage the evening before garbage is picked up. Residents not having garbage pick-up must use closed containers, metal or plastic.

TRANSPORTATION AND DISPOSAL FOR HIRE OF GARBAGE
No person shall, within the corporate limits of the city, transport for hire or other compensation any garbage, trash, rubbish or other refuse of any kind without first obtaining a permit for such purposes from the City Council.

No person shall be granted such a permit unless there is presented to the City Council an application showing the following:
(A) The rates which the applicant proposes to charge for such collection, transportation and disposal of garbage and other refuse;
(B) The applicant will at all times transport all garbage and refuse collected by him or her in a vehicle which has been specifically designed by its manufacturer, and manufactured, for the purpose of the collection, transportation and disposal of garbage, trash, rubbish and other refuse. Proof of ownership of such a vehicle, or proof that the applicant is currently the lessee under a valid and subsisting lease of such a vehicle shall constitute proof that such a vehicle will be used by the applicant in transporting garbage and other refuse; and
(C) The applicant has current and continuing insurance sufficient to indemnify the city against any damages resulting from applicant’s transportation of garbage and other refuse within the city.

Upon approval of such applications by the City Council, a permit shall be issued to the applicant, entitling him or her to engage in the collection, transportation and disposal of garbage, trash, rubbish or other refuse for profit. Each such permit shall be valid for one year from the date of its issuance, and after one year shall expire unless application is made for the renewal of such permit not less than five days before its expiration. The form of such renewal applications shall be as provided in § 50.16.

Any holder of any permit issued pursuant to this subchapter who is found to have falsified his or her application, or who, after making his or her application, is found to have deviated from the requirements of the application, shall forfeit his or her permit.
