§ 118.01 GENERAL PROVISIONS.
   (A)   Every owner, agent, lessee, tenant or occupant of any house, building, flat, apartment or tenement in the city, where persons reside, board or lodge, or where animal or vegetable food is prepared or served, or any private residence, is entitled to keep and maintain, in good order and repair, waste services for the disposal of garbage and collection.
   (B)   Every owner or tenant of an occupied building in the city limits is required to keep and maintain, in good order and repair, garbage containers for the deposit of garbage for collection by a permitted entity.

§ 118.02 CONDITIONS.
   The city's contracted solid waste service provider shall provide solid waste collection service, including bulk and brush collection, to all residential and commercial customers within the city limits. The fee collected for such service provided to residential and commercial customers shall be determined yearly, by the Consumer Price Index.

§ 118.03 COLLECTION OF WASTE BY OTHER ENTITIES.
   (A)   Any waste collection service that is operating in the City of Tool shall be permitted by a fee, to be determined by the city. The city reserves the right to limit the number of waste service vendors it may permit through the year, based on contract, coverage of city, fee schedules, etc.
   (B)   If any business is found to be in violation of this provision by collecting garbage, trash and brush by operation without being permitted, the city shall take action through legal action, in accordance with this chapter.

§ 118.04 SPECIAL COLLECTION AGREEMENTS.
   Nothing in this chapter shall be deemed to prohibit the city from making special agreements and assessing a special collection fee for the collection of items which the city or the exclusive franchisee does not normally collect, or for the city collecting excessive amounts of refuse.
