Whoever suffers to accumulate, on any premises owned or controlled by him or her, any heap or stack of manure in such manner as to omit noxious, disagreeable, or offensive smells, to the annoyance or distress of any person of family, or whoever places any such manure or the contents of any family privy or vault in or upon any public street, alley, or common, is guilty of a nuisance and, on conviction, shall be fined.
