1511.03 Amendments.
   Pursuant to Section 101.6 of the Ohio Fire Code adopted under Section 1511.01, the following amendments are hereby adopted as if part of the code as set forth below.
   Rule 1 Administration
   1. Section 101 General
   101.1 Title.
   Delete entire section and insert the following:
   Pursuant to Ohio Fire Code Section 103, the regulations and additions as set forth herein shall be known as the Fire Prevention Code for the City of Toledo and herein referred to as such or as "this Code."
   2. Section 105.1.2 Types of Permits
   (ii) Delete
   3. Section 108 Board of Appeals
   108.1 Board of appeals established.
   Delete entire section and insert the following:
   The Board of Building Appeals as established in Chapter 1315 shall hear and decide appeals of orders, decisions of determinations made by the code official relative to the application and interpretation of this code. Any person shall have the right to appeal a decision of the Code Official to the Board of Building Appeals. The appeal shall be in writing, detailing the reason for same within seven days to the Board of Building Appeals. When three members are not present to hear an appeal, either the appellant or the appellant's representative shall have the right to request and receive a postponement of the hearing. A new hearing shall be held within five days.
   Rule 2 Definitions
   1. Section 202 General Definitions
   Fire Code Official- Add the following to the definition:
   It shall be the duty and responsibility of the Director of Toledo Fire and Rescue Department to enforce the provisions of the Fire Prevention Code as herein set forth. The designated enforcement officer of this code is herein referred to as the Fire Code Official. The Fire Code Official shall be appointed by the Director of Fire and Rescue Department; and the Fire Code Official shall not be removed from office except for cause and after full opportunity to be heard on specific and relevant charges by and before the appointing authority.
   Rule 3 General Requirements
   1. Section 307.4 Location.
   Add the following to end of section 307.4.3:
   a. Open burning where permits have not been issued shall be extinguished for cause in accordance with OFC 307.5 (Attendance) and further, a fee of double the $100.00 permit fee and fines in accordance with 1511.05 (B) may be assessed.
   Rule 4 Emergency Planning
   See TMC 1513 for additional requirements
   Rule 5 Fire Service Features
   1. Section 507.5.1 Where required.
   Where a portion of a facility or building hereafter constructed or moved into or within the jurisdiction is more than 350' from a hydrant on a fire apparatus access road, as measured by an approved route around the exterior of the building, on site fire hydrants and mains shall be provided where required by the Fire Code Official. The Director of Toledo Fire and Rescue Department or his/her designee may grant exceptions to this regulation based on careful examination of each individual request.
   2. Section 507.5.3 Private fire service mains and water tanks.
   Add the following to the end of section 507.5.3:
   a. Private hydrants shall be supplied by at least an 8 inch main and of the same type used by Public Utilities Department, Water distribution. Plans for private mains shall be submitted to the Chief of the Fire Prevention Bureau for approval prior to installation.
   Rule 6 Building Services and Systems
   1. Section 605.3.1 Labeling.
   Add the following to end of section 605.3.1:
   a. Where the main electrical power disconnect device of a building or industrial complex is locked against unauthorized operation or vandalism, the locking device shall be frangible, and installed in a manner allowing forcible removal by the fire department.
   Rule 15 Flammable Finishes
   1. Section 1504.9 Limited spraying spaces.
   Add the following new wording to the end of Section 1504.9:
   Spot Painting is not permitted without a spray space, booth, or room.
   Rule 26 Welding and Other Hot Work
   1. Section 2605.2.1 Cylinders connected for use.
   Add the following new paragraph to the end of section 2605.2.1:
One portable fire extinguisher with a minimum 2-A:10-B:C rating shall be attached to all portable welding carts.
   Rule 33 Explosives and Fireworks

   Rule 46 Construction requirements for existing buildings.
   Add the following to the end of (a) 4603.7.1 where required.
   1. Section 4603.7 Single and multiple station smoke alarms.
   a. It shall be the responsibility of the owner of all existing one, two, or three family dwelling units, after the effective date of this section to install smoke detectors as provided herein. Smoke detectors shall be installed in all sleeping areas, outside all sleeping areas in the immediate vicinity of the bedrooms and on each level of the dwelling unit, including the basement, where the dwelling has more than one floor. All detectors shall be installed according to the manufacturer's installation instructions with regard to the number of detectors required, location, and spacing.
   b. In dwelling units it shall be the responsibility of the occupant to replace batteries in detectors as required. In multi-family dwelling units, the property owner is responsible for all maintenance other than battery replacement. The tenant may not remove or render smoke detectors inoperable.
   c. After the effective date of this section, at every change of occupancy of every dwelling unit caused by sale, rental, lease or sublease, it shall be the duty of the seller, landlord, lessor or sublessor to certify to the new occupant that the smoke detectors are installed and in proper working order. Failure to comply with this section shall be punishable as set forth herein.
   d. Violation of any provision set forth in Section 1511 shall constitute the following offense:
   (1) A minor misdemeanor for the first offense;
   (2) A misdemeanor of the third degree for subsequent offenses within four years;
   (3) A misdemeanor of the first degree of the court finds that serious physical harm (as defined in Section 501.01(e) of the Toledo Municipal Code) or loss of life occurred during the course of a fire in a dwelling unit which failed to meet the requirements of this section.
