§ 4.07  PROHIBITIONS.
   (A)   HOLDING OTHER OFFICE: Except where authorized by this Charter, no Councilmember shall hold any other municipal office of the Tipp City government or employment in the government of Tipp City during the term for which the Councilmember was elected to the Council, and no former Councilmember shall hold any compensated appointive municipal office or employment until one year after the expiration of the term for which the Councilmember was elected to the Council.
   (B)   APPOINTMENTS AND REMOVALS: Neither the Council nor any of its members shall in any manner dictate the appointment or removal of any municipal administrative officers or employees whom the Manager or any of the Manager's subordinates are empowered to appoint or remove, but the Council may discuss its views pertaining to appointment and removal of such officers and employees with the Manager.
   (C)   INTERFERENCE WITH ADMINISTRATION:  Except for the purpose of inquiries and investigations under § 4.10, the Council or its members shall deal with municipal officers and employees who are subject to the direction and supervision of the Manager solely through the Manager, and neither the Council nor its members shall give orders to any such officer or employee, either publicly or privately, as also provided by § 5.03 of this Charter on the Municipal Manager.
   (D)   SUSPENSION OF § 4.07 (A):  Council may suspend the provisions of § 4.07 (A) of this Charter by a vote of at least five members.  Such suspension shall stipulate that a current Councilmember may hold an office or employment with the City and retain his or her Council seat by forfeiting his or her Councilmanic vote and the suspension shall not exceed the period of thirty (30) days; but Council may renew the suspension for one additional thirty (30) day period.  At the termination of the second thirty-day period the Councilmember must forfeit either his or her Council seat or his or her other City position.  The Council may suspend the provisions of § 4.07 (A) of this Charter, and renew such suspension, as it relates to a former member of the Council, by a vote of at least five members, for any period, as determined by the Council.  The actions of suspension and renewal of suspensions shall be by motion.
