Upon receipt of a written appeal as provided in Section 1309.09 the Zoning Board of Appeals shall set the matter for hearing within thirty days after receiving notice of appeal and the owner shall have the opportunity to appear before the Board and to present evidence that the premise or structure is not in such an advanced state of disrepair for any of the reasons set forth in Sections 1309.03 and 1309.05 as to endanger the health, safety and welfare of the public, or is not a public nuisance.
