1309.05 NOTICE OF REQUIRED REPAIRS.
   (a)    Upon a determination by the Code Official that any building, dwelling or structure is in such an advanced state of disrepair by reason of defective or inadequate plumbing or sanitary facilities; faulty or defective electric wiring; accumulation of debris, filth, rubbish or garbage; general deterioration in the structure by reason of age, neglect, exposure to the elements or vandalism; failure of the exterior enclosure causing exposure to the elements and general deterioration of the structure; partial damage to the structure by reason of fire, windstorm or other calamity; or by reason of deterioration or damage to the foundation, so as to endanger the health, safety and welfare of the public and is therefore a public nuisance, or is otherwise a public nuisance as defined in Section 1309.03, he shall direct the owner of such building, dwelling or structure, in writing by certified mail, at the last known address of the owner, to effect the repairs necessary to put the building in a reasonably safe condition, or, if the owner is unknown or cannot be located by posting on the premises and publishing such a notice to effect such repairs as are necessary to put the structure or premises in a reasonably safe condition, in a newspaper of general circulation in the community for a period of no less than two consecutive weeks.
   (b)    The Code Official shall, in his notice to the property owner, specifically detail the conditions which are in need of repair, the minimum change of the structure and premises which shall restore the building to acceptable condition, and the time which reasonably shall be allowed to undertake the repairs and the maximum time to be allowed for completion.
   (c)    The notice by posting and publication shall be sufficient if it recites that the building has been adjudged to be unsafe, its location by street address or equal is identified, and that the owner may obtain from the Code Official the complete list of observed deficiencies at the Tiffin Fire/Rescue Division offices during regular business hours.
   (d)    Upon receipt of such notice by certified U.S. mail, the owner shall respond by certified U.S. mail or by personal appearance to inform the Code Official as to whether he intends to repair the structure or premises, abate the nuisance or intends to appeal the order to the Zoning Board of Appeals. Failure to respond shall be regarded as refusal to comply unless appeal has been filed within thirty days of receipt of such notice.
