8-2-4: REPAIR OF DETERIORATED SIDEWALKS; LIEN FOR COSTS:
   A.   Order Repair By Owner: Whenever any sidewalk which is now or which may by reason of natural deterioration or decay, or by reason of unevenness, or for any cause whatever, become unfit or unsafe for public travel, or dangerous to the public safety, the Street Superintendent shall require the owner of the premises abutting such sidewalk, or his agent, to immediately repair the same.
   B.   Failure Of Owner To Repair; Action By City: In case of his refusal or neglect to comply with such requisition, or in case no one can be found upon whom to serve such notice to repair such sidewalk, such sidewalk shall be immediately removed, remodeled, rebuilt, paved, cleaned, repaired or newly built under the direction of the Street Superintendent, or such other form of relief as may be required to make the same fit for public travel, as in his judgment may be most expedient.
   C.   Lien For Costs: The costs thereof shall be a lien upon the lot or lots abutting upon such sidewalk, and may be enforced or the amount may be recovered against the owner by a suit before a competent jurisdiction, or may be assessed and collected as a special tax against such lot or lots as in other cases.    D.   Compliance With Document: All sidewalks in need of repair or replacing, excluding Main Street, shall follow the Montana Code Annotated public works document concerning Municipal sidewalks. (2000 Code)
