6-4A-12: PENALTY:
   A.   Dangerous Dogs: Any owner or possessor of a dangerous dog upon violating the provisions of this article by owning or possessing a dangerous dog shall be guilty of a misdemeanor and upon conviction thereof, shall be fined no less than one hundred fifty dollars ($150.00) but not exceeding one thousand dollars ($1,000.00) and/or six (6) months' imprisonment for a first offense. Upon conviction of a second offense for the same dangerous dog, the fine shall be no less than five hundred dollars ($500.00) or alternatively the court may order the euthanization of the dangerous dog. Upon conviction of a third or subsequent offense for the same dangerous dog, the fine shall be no less than one thousand dollars ($1,000.00) or in the alternative the court may order the euthanization of the dangerous dog.
In addition to the fine, an owner or possessor who is found guilty of violating this provision shall pay restitution to the city for all costs and expenses of boarding the dangerous dog. If the dog is euthanized, the owner or possessor who is found guilty of violating the provision shall pay as restitution to the city all costs and expenses of euthanizing the dog.
Any owner found violating the provision for failure to relinquish to a police officer, shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined no less than one hundred fifty dollars ($150.00), but not exceeding five hundred dollars ($500.00) and/or six (6) months' imprisonment for each offense.    B.   Nuisance Dogs: Any owner found violating any provision of this article shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than one hundred dollars ($100.00) but not exceeding five hundred dollars ($500.00) and/or six (6) months' imprisonment.    C.   Licensing Penalties: Any owner found violating any provision of the licensing provisions of this article shall, upon conviction, be guilty of a misdemeanor and may be subject to penalty as provided in section 1-4-1 of this code. (Ord. 363-2015, 1-12-2016)
