A. It is a violation of this chapter for any parent, guardian or other person having the care, custody or control of a minor under the age of eighteen (18) years to allow such minor, either expressly or by neglect to duly exercise such care, custody or control, to wander, play, loiter on the public streets, highways, parks and playgrounds after the hour prescribed in section 6-3-7 of this chapter.
B. The burden for proving the exception noted in this chapter is on the defendant.
C. In any prosecution under this section, it shall not constitute a defense that the parent, guardian or other adult person having the care, custody or control of such minor does not have knowledge that such minor did wander, stroll or play in the public places during the hours of the curfew.
