§ 157.44 FLOODWAYS.
   (A)   Located within the areas of special flood hazard established in § 157.07 of this chapter are areas designated as floodways.
   (B)   Since the floodway is an extremely hazardous area due to the velocity of floodwater, which carries debris and potential projectiles and has erosion potential, the following provisions shall apply.
      (1)   Encroachments are prohibited, including fill, new construction, substantial improvements and other development, unless certification by a registered professional engineer or architect is provided demonstrating that encroachments shall not result in any increase in flood levels within the community during the occurrence of the base flood discharge.
      (2)   If division (B)(1) above is satisfied, all new construction and substantial improvements shall comply with all applicable flood hazard reduction provisions of this subchapter.
