§ 153.02 AMENDMENTS TO INTERNATIONAL MECHANICAL CODE.
   The following sections of the Code adopted under this chapter are amended as follows.
   (A)   Section 106.5, Schedule of Permit Fees, is amended to read as follows:
   On all mechanical work requiring a permit, as set forth in section 106.5.2, a fee for each mechanical permit shall be paid at the time of approval of the application. All fees shall be approved by the City Commission and a copy of the current fees are to be posted at the City Hall Annex, 928 5th Avenue North, Texas City, Texas.
   (B)   Section 109.1, Construction Board of Adjustments and Appeals, is amended to read as follows:
   A Board of Adjustments and appeals is hereby established for the purpose of providing for the final interpretation of provisions of this code. The Board of Adjustment as established and adopted by the zoning ordinance of the City of Texas City, in addition to its present duties, shall be and become the Board of Adjustments and appeals and shall perform all of its duties and shall have all of its power.
   (C)   Section 306.1, Clearances for maintenance and replacement, is amended by adding new section 306.1.2 to read as follows:
   306.1.2 New residential dwellings: All dwellings with a five (5) foot side yard setback requirement shall be prohibited from having outside air conditioning units located within the five (5) foot side yard setback.
   (D)   Heating and air conditioning permit fees: All fees shall be approved by the City Commission and a copy of the current fees are to be posted at the City Hall Annex, 928 5th Avenue North, Texas City, Texas.

CONTRACTORS
§ 153.15 DUTIES OF HEATING AND A/C ADVISORY BOARD.
   It shall be the duty of the Board to hear the appeals of persons aggrieved by interpretation of the Mechanical Code or by a decision of the Inspector and make recommendations to the staff.

§ 153.16 COMPOSITION OF BOARD OF EXAMINERS.
   There is hereby created a six-member Contractors and Installers Examiners Board consisting of:
   (A)   The Building Official;
   (B)   One duly licensed contractor appointed by the City Commission;
   (C)   Two persons appointed by the City Commission;
   (D)   A mechanical engineer appointed by the City Commission; and
   (E)   The Fire Marshal or designee.

§ 153.17 TERM OF OFFICE OF MEMBERS OF BOARD OF EXAMINERS.
   Except for city officials who are members, members of the Board of Examiners established by this subchapter shall hold office for a period of two years, unless sooner removed by a vote of the City Commission.

§ 153.18 EXEMPTION FOR WORK BY HOMEOWNERS.
   Nothing in this subchapter shall prohibit any homeowner from personally installing or repairing any heating, air conditioning or mechanical refrigeration equipment in the home in which he or she resides. No unlicensed person shall be employed by the homeowner to assist him or her in any such work.
