9-4-4: DANGEROUS BUILDINGS WITHIN FIRE DISTRICT:
Any frame building or structure within the Fire District of the City, as prescribed by ordinance, 1 which has been or may be damaged by fire, decay or other causes to the extent of fifty percent (50%) of its value shall be torn down and removed or rebuilt with fire retardant walls.
Upon written notice filed with the City Clerk by the Health and Building Officer or the Fire Chief, to the effect that any building has been so damaged, the Clerk shall notify the Mayor and City Council and the Mayor, with the consent of the City Council, shall appoint a three (3) man board to determine whether or not such building or structure has been damaged fifty percent (50%) of its value. Notice of the appointment of this three (3) man board shall be served upon the owner of the premises involved, by personal service or registered mail at his last known address, and the notice shall give the time and place the board will meet to consider the matter, and that the owner may be present at such meeting if he so desires. If the board of three (3) members determines that the building in question has been damaged to the extent of fifty percent (50%) of its value, it shall be the duty of the owner to tear down and remove the said building within twenty (20) days after the finding of such board or to remodel it to comply with the requirements for new buildings in the Fire District, and it shall be unlawful to occupy or permit the occupancy of such building after such finding until it is so remodeled.
