8-4-6-1: FIRE HYDRANTS OUTSIDE CITY LIMITS:
   A.   Application For Fire Hydrant Permit: Any city water customer whose property is furnished city water outside of the corporate limits of the city may apply for a fire hydrant permit for the installation of a fire hydrant to be installed and located at or near the applicant's property. The water superintendent in his sole discretion shall determine the form and requirements of such application and permit from time to time; provided however, such application shall include at least the following information and documents:
      1.   The identity of the specific requested location of the fire hydrant.
      2.   A description of the nature and kind of property to be initially serviced by such fire hydrant.
      3.   The name and address of the excavator and licensed plumber who would be excavating, installing, and connecting the fire hydrant to the city's water main or service line.
      4.   All owners of the property where the fire hydrant is to be located must sign the application.
   B.   Issuance Of Fire Hydrant Permit; Insurance; Hold Harmless And Indemnity:
      1.   The decision whether to issue a fire hydrant permit to install and locate any fire hydrant to any city water customer to service property located outside the city limits is subject to the sole discretion of the water superintendent.
      2.   However, no fire hydrant permit shall be issued until and unless the applicant provides the city clerk with certificates of insurance provided by a reputable insurance company that provides "occurrence" type policy insurance coverage for each excavator and Illinois licensed plumber who will be doing any work concerning the fire hydrant; and such insurance coverage shall be of the kind and at least in the amounts as set forth in section 8-1D-2 of this title and such insurance further names as an additional named insured the "city of Taylorville, Illinois, a municipal corporation, and its elected and/or appointed mayor, city council, aldermen, officials, officers, employees and agents".
      3.   As a condition of issuance of each fire hydrant permit, each property owner who is issued a fire hydrant permit and their respective excavators and Illinois licensed plumbers shall agree to and shall hold harmless and indemnify the city from any and all claims, demands, suits or causes of action of any kind, nature, or extent whatsoever that relates directly or indirectly or consequentially from any and all excavation or installation work or activities concerning such fire hydrant.
   C.   Fire Hydrant, Excavation, Installation, Inspection Costs And Fees, And Ownership Of Fire Hydrant:
      1.   Each property owner who is issued a fire hydrant permit shall pay the city for the cost of the fire hydrant and all other materials and shall further pay for all costs and expenses relating to the excavation, installation, and connection of the fire hydrant to the city's water supply, and all city inspection fees.
      2.   Before such fire hydrant is made operational, the property owner(s) shall provide the city with properly executed full and final mechanics' lien waivers for all work and materials associated with the excavation and installation of such fire hydrant.
      3.   The subject fire hydrant shall be installed in the location that is approved by the water superintendent or his designee. The installation and connection of the subject fire hydrant shall be made according to any plans and specifications that are approved or required by the water superintendent or his designee.
      4.   Upon completion of the installation of the subject fire hydrant and its connection to the water supply to the satisfaction of the water superintendent, the subject fire hydrant shall become and remain the sole property of the city. (Ord. 3635, 9-3-2013)
