6-3-5: EMERGENCY SNOW ROUTES 4 :
   A.   Purpose: It is hereby found and declared to be necessary, desirable and in the interest of the general health, safety and welfare to enhance the safer and more expeditious movement of police, fire, emergency and other vehicles within the city that emergency snow routes be designated and the movement or parking of vehicles thereon be regulated to facilitate the removal of snow from the snow routes.
   B.   Declaration Of Snow Emergency: The superintendent of streets and sewers 2 is hereby authorized and directed to cause or provide for, either by such person or by one of those employees of the city designated and authorized by said superintendent, the declaration of a snow emergency when it is determined, in the opinion of the declarer of said emergency, that new snow has accumulated in, on or along any emergency snow route in the city to a depth of two (2) or more inches and further to declare such emergency to be ended when it is reasonably deemed the same has then exhausted its purposes.
Such declaration shall be in writing over the signature of the declarer and shall be endorsed with the time and date thereof along with a statement of the manner, means and extent the same was or was attempted to be communicated to the news media and the public and which shall be, as soon as practicable, filed with the city clerk who is authorized and directed to receive and preserve the same for public inspection in some appropriate manner for a period of not less than two (2) years and by the same method and manner the ending of said emergency shall be declared.    C.   Parking Restricted: When appropriate signs or markings giving notice thereof have been provided, in addition to other regulations applicable thereto, no person shall park or leave standing any vehicle in the roadway of an emergency snow route in the city at any time during the period commencing one hour after a snow emergency has been declared and extending to the hour at which such emergency has been declared to be ended.    D.   Towing Illegally Parked Vehicles: Any peace officer may cause any vehicle found to be parked or left standing in violation of the provisions hereof to be towed away and impounded, whereafter, the same may be held until all towing and storage charges relating thereto are paid by the person seeking to obtain the release thereof.
   E.   Prima Facie Proof: Whenever any vehicle shall have been parked or left standing in violation of any provisions hereof, any person or entity named as registered owner thereof shall be prima facie responsible for such violation and subject to the penalty therefor.
   F.   Rules And Regulations: The superintendent of streets and sewers is hereby authorized and directed to promulgate such rules and regulations and take such actions as may be deemed by him to be reasonable and desirable to carry out the intent and purpose of this section.
   G.   Violation; Penalty: Any person or entity parking or leaving standing any vehicle in violation of the provisions of this section or causing the same, shall, upon conviction, be fined as provided in section 1-4-1 of this code. (Ord. 2128, 2-6-1984; amd. 1993 Code)
