6-2-3-1: FINES:
   A.   Fines Established: In addition to the towing and impoundment provisions of this code relating to parking violations, the following penalties will be applicable to the owner or operator who is issued a traffic violation notice for violating any of the provisions listed below, providing the amount listed is paid to the city treasurer within fourteen (14) days beginning on the first day after the issuance of the notice or as specified below. Payments received by mail shall be credited as paid on the date of postmark.

   B.   Late Payment Of Fines: If the violation notice is not paid within fourteen (14) days, beginning on the day after issuance of the notice, the person may avoid prosecution for violating a parking provision only by paying the following amounts:

   C.   Failure To Pay Fines: The owner or operator of any vehicle or pedestrian cited for violation of any parking or pedestrian restriction of this section who shall fail to pay the sums provided above to avoid prosecution for the offense, shall be prosecuted for violating this section and upon conviction, shall be punished by a fine of not less than twenty five dollars ($25.00) for overtime parking, and not less than thirty dollars ($30.00) for all other violations, excluding the fine for parking in handicapped parking spaces. All fines are exclusive of court costs. No fine shall be more than three hundred fifty dollars ($350.00) for any single offense. (Ord. 3414, 1-20-2009)
   D.   Payment Of Fines; Receipt; Disposition Of Funds: The sum as herein provided shall be paid to the municipality by inserting such sum in the envelope type notice of such violation attached to the illegally parked vehicle and depositing the same in any of the courtesy boxes conspicuously located in the city square, such box being plainly marked for such purpose, or by delivering the sum specified on such notice of violation to the office of the city treasurer in the city hall.
A receipt shall be issued for all money so received in person by the city treasurer's office and such money shall be deposited by the city treasurer to be used in the manner provided for the disposition of fines for traffic violations. Upon payment of such sums as herein provided, the members of the police department are hereby authorized to refrain from instituting a prosecution for the alleged offense involved.
   E.   Responsibility: In all cases of parking violations except as provided in subsection F of this section, the persons in whose name the vehicle is registered shall be responsible for the violation, as well as the person in whose actual possession the vehicle was, at the time of the violation.
   F.   Information Provided: Every person in whose name a vehicle is registered pursuant to law and who leases the vehicle to others after receiving written notice of a violation of this traffic code or any ordinance restricting or prohibiting parking involving the vehicle, shall, upon written request by the city, provide the city with the name, address, and other identifying material of the lessee at the time of the offense, and the identifying number upon the registration sticker or stickers of the vehicle.    G.   Prosecution: The city may prosecute in a court of law any person receiving parking violations as defined in this title and/or refer any one or more of said parking violations to a collection agency to collect the amount due the city. (Ord. 3435, 8-3-2009)
