AMENDING SECTION 3-6-3A TO CHAPTER 6
OF TITLE 3 OF THE TAYLORVILLE CITY CODE
(re: revising paragraph B)
 
   NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF TAYLORVILLE, CHRISTIAN COUNTY, ILLINOIS, AS FOLLOWS:
Section 1:   Section 3-6-3A of Chapter 6 of Title 3 of the Taylorville City Code is hereby amended and shall now read as follows:
3-6-3A: CIGARETTES, TOBACCO, ALTERNATIVE NICOTINE PRODUCTS, AND VAPE PENS ADVERTISEMENTS, BANNERS, SIGNAGE, ETC. RESTRICTED:
 
A.   A Cigarette and Tobacco Dealer licensee is permitted to locate and maintain one (1) outdoor advertising banner affixed to a metal pole with a ground spike on the exterior of the licensed premises that advertises or displays or indicates the presence or availability of cigarettes, tobacco, tobacco products, alternative nicotine products, electronic cigarettes, or nicotine containing products (e.g. Vape Pens) within the licensed premises, provided such banner is either a feather flag style banner or a rectangle flag style banner or a teardrop flag style banner, not to exceed in any case a width of two feet (2’) and an overall height of eight feet (8’) from the ground level.
 
B.    A licensee is permitted to locate and maintain one sign, not to exceed twenty-four inches (24”) by thirty inches (30”) in size, affixed on the exterior of the licensed premises that advertises or displays or indicates the presence or availability of, alternative nicotine products, electronic cigarettes, or nicotine containing products (e.g. Vape Pens) within the licensed premises.
 
C.    A licensee is permitted to locate and maintain one sign, not to exceed twenty-four inches (24”) by thirty inches (30”) in size, affixed in the interior of the licensed premises where such signage is visible to persons outside the licensed premises that advertises or displays or indicates the presence or availability of cigarettes, tobacco, tobacco products, alternative nicotine products, electronic cigarettes, or nicotine containing products (e.g. Vape Pens) within the licensed premises.
 
D.   Except as otherwise permitted in the preceding subparagraphs 1., 2, and 3, it shall be unlawful for any person or licensee to place, locate, or maintain any flag, banner, signage or any other device or structure of any kind, nature or extent whatsoever that advertises or displays or indicates the presence or availability of cigarettes, tobacco, tobacco products, alternative nicotine products, electronic cigarettes, or nicotine containing products (e.g. Vape Pens)within the licensed premises on or about the exterior of the licensed premises and/or in the interior of the licensed premises such that it is visible to persons outside the licensed premises and/or on any adjoining property.
 
E.   It shall be unlawful for any person or licensee to place, locate, or maintain any signage or banner or any device or structure of any kind, nature or extent whatsoever on City property or on any City right-of-way or on any City boulevard or on any City street, roadway or alleyway that advertises or displays or indicates the presence or availability of cigarettes, tobacco, tobacco products, alternative nicotine products, electronic cigarettes, or nicotine containing products (e.g. Vape Pens).
 
   Section 2.   That the provisions of other City of Taylorville Ordinances, to the extent they duplicate, conflict with or otherwise effect the validity hereof, shall be disregarded.
   Section 3:   That if any section, clause, provision or portion of this Ordinance shall be held to be invalid or unconstitutional by any Court of competent jurisdiction, such holding shall not affect or otherwise impair any other section, clause, provision or portion of this Ordinance which is not, in or of itself, invalid or unconstitutional.
   Section 4:   This Ordinance shall be effective upon its passage, approval, adoption, and publication in pamphlet form as provided by law.
   ON MOTION DULY MADE AND SECONDED and pursuant to roll call vote, this Ordinance was passed, approved, and adopted this 20 th day of FEBRUARY 2024 by at least a majority affirmative vote of the City Council.

   The pamphlet form of Ordinance No. 4228, including the Ordinance and a cover sheet thereof was prepared, and a copy of such Ordinance was posted in the City Hall, commencing on February 21, 2024, and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the Office of the City Clerk.
