10-16-4: SPECIAL USE PERMIT APPLICATION - APPLICATION FEE AND ANNUAL RENEWAL FEE:
   A.    A Special Use permit application shall be submitted to the Zoning Enforcing Officer. The application must be on a form approved by the Zoning Enforcing Officer and must be accompanied by such documents and descriptive information sufficient to enable the Plan Commission and City Council to determine whether the requirements of this Chapter will be satisfied, and such other information as may be specified on the application form. The application for a Special Use permit must also be accompanied by the application fee required for each such retail facility. The Special Use permit application fee is a non-refundable Ten Thousand Dollars ($10,000.00) for each application for such retail facility; and the aforesaid annual nonrefundable renewal fee for said Special Use permit shall be Five Thousand Dollars ($5,000.00).
The Zoning Enforcing Officer will review the application materials for completeness and may request that the applicant provide additional documents and/or information. When the Zoning Enforcing Officer determines that the application is complete, the Zoning Enforcing Officer will forward a copy of the application to the City Council and Plan Commission.
   B.   The City Council and Plan Commission will conduct a public hearing on the application within ninety (90) days after the application is determined by the Zoning Enforcing Officer to have been satisfactorily completed and submitted and following the statutory minimum 15-day public notice publication in the Breeze-Courier or in a local newspaper published within the City.
