3-11-8: ROLL-OFF CONTAINER PERMIT REQUIRED AND CONDITIONS OF PERMIT:
   A.   It shall be unlawful for any person to locate, place, use, or maintain any roll-off container on any city street, alleyway, roadway, sidewalk, or other public way without first obtaining a roll-off container permit from the city. (Ord. 3124, 5-19-2003)
   B.   The fee for each roll-off container permit shall be twenty five dollars ($25.00) for each roll-off container located, placed, used, or maintained at each general location for each period of time of thirty (30) days or less. An additional fee of twenty five dollars ($25.00) shall be required for each additional period of time of thirty (30) days or less at the same or nearby location. (Ord. 3372, 2-19-2008)
   C.   A roll-off container permit shall not be issued until after the city street and sewer superintendent approves of the intended location of each roll-off container on such city street, alleyway, roadway, sidewalk, or other public way and has inspected such roll-off container and indicates to the city clerk that such roll-off container(s) and the intended location thereof meet(s) the requirements of this chapter.
   D.   Each roll-off container must have affixed thereon reflectors on all four (4) corners of each roll-off container and at a height that would be within the direct headlight beam of vehicles that may approach such roll-off container.
   E.   The name, address, and twenty four (24) hour phone number of the scavenger who owns each roll-off container must be clearly and visibly marked on such roll-off container in reflective letters and numbers.
   F.   No roll-off container permit shall be issued unless a scavenger who holds a current scavenger license issued by the city is providing such roll-off container.
   G.   A roll-off container permit may be denied issuance upon the recommendation of the city street and sewer superintendent if such roll-off container has a garbage collection capacity of more than twenty (20) cubic yards.
   H.   It shall be unlawful for any person to locate, place, use, or maintain any roll-off container on any city street, alleyway, roadway, sidewalk, or other public way unless such roll-off container is protected by lighted barricades placed in the front and the rear of the roll-off container and the sides of the roll- off container facing vehicular and/or pedestrian traffic have reflective tape of at least two inches (2") in width vertically affixed to such side(s) of the roll-off container.
   I.   It shall be unlawful for any person to locate, place, use, or maintain any roll-off container on any street, alleyway, roadway, sidewalk, or other public way that will interfere with vehicular traffic or that reduces the usable vehicular width of such street, alleyway, roadway, or other vehicular public way to less than eighteen feet (18').
   J.   It shall be unlawful for any person to deposit or store any materials or garbage on any street, alleyway, roadway, sidewalk, or other public way other than in a roll-off container for which a roll-off container permit has been issued under this chapter.
   K.   With or without a roll-off container permit having been issued under this chapter, it shall be unlawful for any person to use any city sidewalk during the alteration, repair, improvement, or construction of any building or structure unless such sidewalk is protected by a temporary roof whenever danger from falling objects is present and unless such sidewalk is covered to protect such sidewalk from mortar, paint, etc., or any other construction materials of any kind, nature, or extent whatsoever.
