3-3-18: CLOSURE OF LICENSED PREMISES FOR REPEATED FIGHTING DISTURBANCES:
It is hereby declared an immediate threat to the welfare of the community for the continued operation of any licensed premises where repeated occurrences of fighting or threat of fighting occurs either inside the licensed premises or originates from the licensed premises.
In the event the City Police Department responds to more than one fighting disturbance or call within a consecutive twenty four (24) hour period relating to any fighting or threat of fighting between or among any persons either inside or that which originates from the licensed premises, the Mayor, or any City police officer responding to such disturbance or call, may without notice or hearing, issue a written order immediately closing the licensed premises for not more than seven (7) days.
Such written order shall state the reason for such closure, and give the licensee an opportunity to be heard during the closure period. If such licensee shall also be engaged in the conduct of another business or businesses on the licensed premises such written order shall not be applicable to such other business or businesses.
