3-3-1: DEFINITIONS:
Unless the context otherwise requires, the following terms, as used in this Chapter, shall be construed according to the definitions given below:
ALCOHOLIC LIQUOR: Any spirits, wine, beer, ale or other liquid containing more than one-half of one percent (0.5%) of alcohol by volume, which is fit for beverage purposes.
BOWLING ALLEY: A business establishment open to the general public on the premises for the game of bowling (i.e., rolling a large, heavy ball down long narrow smooth wooden floor lanes or alleys toward a set of pins to knock them down) and such premises has at least six (6) such bowling lanes or alleys, and where alcoholic beverages are sold at retail for consumption on the premises.
BREWPUB: A person who manufactures microbeer only at a designated premises to make sales to importing distributors, distributors, and to nonlicensees for use and consumption only, who only stores microbeer at the designated premises, and who is allowed to sell only microbeer at retail from the licensed premises, provided that a brewpub licensee shall not sell for off premises consumption more than fifty thousand (50,000) gallons per year.
CLUB:
   A.   A not for pecuniary profit corporation authorized to transact business in the State of Illinois and in good standing, organized and operated solely for the promotion of some common object other than the sale and consumption of alcoholic liquors, kept, used and maintained by its members through the payment of annual dues and owning or hiring or leasing a building or space in a building of such extent and character as may be suitable and adequate kitchen and dining room space and equipment and maintaining a sufficient number of servants and employees for cooking, preparing and serving food and meals for its members and guests; provided, that such club files with the Mayor at the time of its yearly application for a license under this chapter a list of names and residences of its officers and directors, and that no member or any officer of the club shall be paid or directly receive a salary or other compensation for the distribution or sale of alcoholic liquor to the club or its members or its guests beyond the amount of such salary as may be fixed and voted at any annual meeting by the members or by its board of directors or other governing body out of the general revenue of the club.
   B.   A corporation authorized to transact business in the State of Illinois and in good standing, organized and operated according to its charter primarily as a body fitness, development and physical improvement facility exclusively for the benefit of its members and authorized guests and maintained principally from membership dues and fees. Such club shall submit a current list of its directors and officers and residential addresses thereof to the Mayor in conjunction with annual application for renewal of its liquor license. Alcoholic beverages shall not be sold on the premises at any time while a daycare center is in operation.
   C.   Club shall not include any municipal corporation, township, public park district, or any other governmental entity.
PERSON: Any public or private corporation, firm, partnership, limited partnership, association, organization, or any other group acting as a unit, as well as a natural person.
GROCERY STORE: A public place whose primary business is the retail sale of food, either fresh, prepackaged, frozen, or preserved, and household non-food goods, supplies or items, healthcare and personal care products; and includes the retail sale of alcoholic beverages or liquor for consumption on the premises. It does not include a "convenience store" as defined in this Chapter, but it can include a "supermarket" which is commonly considered a larger version of a grocery store.
RESTAURANT:
   A.   Any public place whose primary business is kept, used, maintained, advertised and held out to the public as a place where food and meals (including nonalcoholic and/or alcoholic beverages) are regularly and actually cooked, prepared, and served for consumption on and off the premises of such public place, such public space being provided with adequate and sanitary kitchen and dining room equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable food and meals for the general public for consumption on the premises or for carry out of food and meals that are prepared and cooked on the premises for consumption off the premises. A restaurant shall not include a retail grocery store or supermarket that primarily sells groceries, food and nonfood products, and may or may not include the preparation or cooking of hot or cold food, deli, bakery, meat, poultry or fish items; and an restaurant shall not include a convenience or general store that is primarily a retail business that stocks and sells a range of everyday items such as groceries, snack foods, confectionery, cold or hot food, sandwiches, pizza, soft drinks, alcohol for consumption off the premises, tobacco products, sundries, and motor vehicle gasoline and/or diesel fuel.
   B.   Shall also mean any public place whose primary business is a pharmacy operated by an Illinois licensed pharmacist or Illinois licensed pharmacists for the preparation, dispensing, and retail sale of prescription and over the counter pharmaceutical drugs or medication and medical supplies and sundries, and which includes an ancillary on site restaurant business that is kept, used, maintained, advertised and held out to the public as a place where food and meals (including nonalcoholic and/or alcoholic beverages) are regularly and actually cooked, prepared, and served for consumption on or off the premises of such public place, such public space being provided with adequate and sanitary kitchen and dining room equipment and capacity and having employed therein a sufficient number and kind of employees to prepare, cook and serve suitable food and meals for the general public for consumption on the premises or for carry out of food and meals that are prepared and cooked on the premises for consumption off the premise; and includes the retail sale of alcoholic beverages or liquor for consumption on the premises.
RECEPTION HALL: Any building regularly kept, used, maintained, advertised and held out to the general public by the owners thereof as a place inside of which building is available for rent, for a period of less than twenty four (24) hours for any one occasion, by the general public to have wedding receptions, birthday receptions, anniversary receptions, reunion receptions, fundraiser events, parties, or other similar special events or celebrations; and includes the retail sale of alcoholic beverages or liquor for consumption on the premises.
RETAIL SALE: The sale for use or consumption and not for resale.
TAVERN OR LOUNGE: A business establishment, other than a bowling alley, whose primary business is the retail sale of alcoholic beverages or liquor for consumption on and off the premises.
