§ 71.71 RESTRICTIONS ON COMMERCIAL VEHICLES.
   (A)   For the purpose of this section the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      (1)   "BUYER." A person who buys or contracts to buy goods.
      (2)   "COMMERCIAL VEHICLE." Any truck, truck tractor, trailer or semi-trailer, other than a recreational vehicle.
      (3)   "CONSTRUCTION SITE." Any lot, parcel or tract of land for which there is a valid, unexpired Taylor Mill building permit conspicuously posted thereon.
      (4)   "FARM." Any parcel or tract of land which consists of at least five (5) contiguous acres, which is used for agricultural or horticultural purposes including, without limitation, livestock and livestock products, poultry and poultry products, grain, hay, soybeans, tobacco, pastures and other crops, timber, orchards, fruit, vegetables, flowers and ornamental plants, along with buildings and other structures necessary therefor, including, without limitation, dwellings for the owners and operators thereof.
      (5)   "GOODS." Any property which is both moveable and tangible.
      (6)   "RECREATIONAL VEHICLE." Has the same meaning therefor provided in KRS 219.320(8).
      (7)   "SELLER." A person who sells or contracts to sell goods.
      (8)   "SEMI-TRAILER." A wheeled vehicle with a load capacity of over 1,500 pounds, which is designed to have its front end supported and pulled by a truck or truck tractor, as defined herein.
      (9)   "STREET." Any street or highway other than those streets or highways maintained by Kenton County or the Commonwealth of Kentucky.
      (10)   "TRAILER." A wheeled vehicle with a load capacity of over 1,000 pounds, which is designed to be pulled by a, truck or truck tractor, as defined herein, but supported by its own wheels, independent of any other support.
      (11)   "TRUCK." Any motor vehicle with a declared gross weight in excess of 6,000 pounds, other than emergency vehicles of the city.
      (12)   "TRUCK TRACTOR." Any motor vehicle designed to pull and support the front end of a semi-trailer.
   (B)   No person shall cause or permit the operation or location of a commercial vehicle upon any portion of any street in the city except for the purpose of delivery of goods from a seller to a buyer who is either a resident or owner of real estate which is contiguous to any portion of the street.
   (C)   Nobody shall conspire, promote, cause, permit, allow, aid, assist, encourage or engage in the location of any parked commercial vehicle outside of a garage or other enclosure, on any lot or parcel of real estate in the City other than a farm, or construction site, or any public right-of-way abutting thereon, unless such commercial vehicle is being used for the purpose of the receipt or delivery of tangible items to or from a resident or owner of such parcel of real estate, other than the owner or operator of such commercial vehicle.
   (D)   A violation of this section occurs upon any non-compliance with any provision of this section, by either act or omission; and each and every separate non-continuing occurrence thereof, and each and every day of any continuing occurrence thereof is a separate violation of this section.
